A class action settlement has been reached with MultiCare Health System to resolve allegations that the company violated the Telephone Consumer Protection Act (TCPA) by placing prerecorded calls (robocalls) to the cell phones of patients without their consent.
The alleged calls contained messages from an artificial voice that sought information from patients about their visit to the hospital, as well as potential sources of payment.
MultiCare denies the allegations set forth in the TCPA lawsuit and asserts that these phone calls were made with patient consent and were carried out lawfully by a company named Hunter Donaldson.
Under the terms of the settlement, both sides agreed to a compromise to end the lawsuit, and there was no establishment of fault. Both parties entered into the settlement to avoid the time, expense and risk of further litigation.
Who’s Eligible
You are included in the settlement if you:
- Received treatment at a MultiCare facility
- Signed MultiCare’s Financial Agreement and Conditions of Treatment forms
- Received a prerecorded Hunter Donaldson call on your cell phone on or after July 7, 2010.
Potential Award
Up to $2,500.
Class Members will receive an equal share of the settlement up to $2,500, which will vary depending on the number of eligible claims received. If an individual received more than five eligible calls, additional payments of $500 per call may be available.
Proof of Purchase
N/A
Claimants must simply submit a valid Claim Form with their name and address, the cell number where the prerecorded call was received and a sworn statement that you were a patient at a MultiCare facility.

My claim was rejected as well in spite of being informed that all claims were accepted ( Fla ) !!
I am not a part of this settlement, nor did I apply. I came here just to see how things were going since people on the facebook page kept asking about this lawsuit. I am shocked that people have to wait 60 days for the second check. It’s a blatant attempt by the claims administrator to keep “working” and billing the class. This lawsuit didn’t have many claims and it’s my understanding that not everyone has to submit a w-9. The claims admin KNOWS what everyone is entitled to after the first $590 checks were mailed. Once someone submits a w-9, they should be processing their check. The fact that they are going to wait until the middle of February to mail the rest of the money shows a blatant disrespect for the class and the class attorney’s shouldn’t allow them to wait that long.

I was rejected also, not understanding why. They said that all my claims were rejected. But if i am a victim of any old or new cases , i will summit my claim form. So how can we put a class action lawsuit against them for rejecting eligible clients? Anyone with me?

I emailed them, received a response within 2 hours saying that my claim was rejected
Nothing again today in Indiana. I emailed them also George,but I have yet to get a reply.
I cannot help but think that something is off here. Could the next person that supposedly receives a check post a picture of even the envelope that it arrived in and the state that it was received.
They only gave checks too those. Who received a letter in the mail
