Mercedes-Benz USA LLC has agreed to settle a class action lawsuit over allegations its Sprinter vans have an air conditioning defect that causes the roof to leak.

If you owned or leased a 2010-2014 model year Mercedes-Benz or Freightliner Sprinter 2500 or 3500 with a rear air conditioning unit, your rights may be affected by this class action settlement.

If approved, the Mercedes class action settlement will resolve allegations that Mercedes distributed certain Sprinter vans equipped with rear air conditioning units that caused water to leak into the interior of the van.

The Mercedes Sprinter class action lawsuit asserts claims for fraudulent concealment, violation of California’s Song-Beverly Consumer Warranty Act, California’s Consumers Legal Remedies Act, California’s Unfair Competition Law and the New Jersey Consumer Fraud Act. The complaint also asserts fraud and warranty claims.

Mercedes-Benz denies the allegations and maintains that there is no defect related to the design or installation of the air conditioning units in its Sprinter vans. However, the car company has agreed to settle the Sprinter class action lawsuit to avoid the burden and expense of ongoing litigation.

Class Members who wish to exclude themselves from or object to the Sprinter air conditioning settlement must do so no later than June 16, 2016.

Who’s Eligible

Class Members of the Mercedes Sprinter settlement include all current and former owners or lessees of 2010-2014 model year Mercedes-Benz and Freightliner Sprinter 2500 or 3500 vans equipped with the original air conditioning unit. To be eligible for benefits from this settlement, Class Members must have purchased or leased their vehicles in the United States.

Potential Award

If approved, the Mercedes class action settlement will provide for an extended warranty on the A/C units, reimbursement for reasonable costs of repairs, and a modification to the maintenance service checklist to include an inspection of the allegedly affected vans’ roofs for water marks or other signs of water damage.

Extended Warranty: Mercedes will extend the warranty on the original-equipment rear air conditioning units in the affected vans for covered water leaks to the first seven years or 125,000 miles of the vehicle’s life (whichever occurs first). The extended warranty will also cover damage to the vehicle’s upholstery, headliner, or other original equipment parts that are damaged by warranty-covered water leaks. To receive this benefit, Class Members must bring their vehicles to an authorized Sprinter Service Center within the extended warranty period.

Reimbursement for Repairs: Mercedes has agreed to reimburse reasonable and necessary costs for repairs that would have been covered by the extended warranty period. To receive this benefit, Class Members must submit a timely and valid Claim Form, copies of repair orders or itemized invoices, and proof of payment.

Update to Maintenance Checklist: Under the terms of the Sprinter class action settlement, Mercedes will also modify the “Maintenance Service/B-Service Sheet” checklist to include inspection of the interior roof for water marks or other signs of water damage near the rear air conditioning unit in the allegedly affected vans.

Proof of Purchase

Class Members who are seeking reimbursement for repairs that took place during the extended warranty period must submit copies of repair orders or itemized invoices and proof of payment.

    My 2017 sprinter just recently had repair over 3000 I just found out about this problem with sprinters just now looking it up online. Is there another class action law suit for the 2017 sprinter vans?
    the water started pouring from the roof ac unit when i made a turn and was confused by what happened a couple weeks ago.

    I also have a 2013 sprinter I bought less than 6 months ago. When it rains it pours I am pissed they will not cover it and want 1800.00 to correct their mistake. When is another lawsuit going to be filed??

    I also have 2016 sprinter 2500, and every time it rains it leaks inside my van allot! Mercedes Benz continues to fail in taking corrective action in their manufacture process. The federal court disposition failed to address and ensure product compliance to cover future manufacture builds. The manufacture continues to add defective parts on their newer Sprinter Vans and plus they will charge you the customer to repair their mistake.

      I’m in my 3rd mercedes sprinter 2500 I currently have a 2017 ….. all 3 have had A leaking AC seal where water rushes in every time it rains !!!!!!

    Have 2016 sprinter 3500, everytime it rains it leaks inside alot! Is there another class action law suit for 2016 and newer sprinters with this problem. I think the other class action lawsuit was for 2015 and older. Let me know please thanks

    My situation is I bought a 2105 sprinter in June and only had 22k miles. All is good, until I go vacation for 9 days and it’s pouring rain while I’m gone. I get back open the door and there is a gallon or more of water on the seat, the bed, and several thousand dollars worth of electronics.

    Dealer and Mercedes say it’s out of warranty and will cost $1900 to fix. Local repair shops have never heard of the issue, I’m sure most people had this defect repair done under warranty in the first year or two.

    The previous owner of my van either didn’t drive in the rain or was lazy.

    I have 2015 Mercedes Sprinter 2500 with A/C unit top from manufacture. Purchased from Seattle Mercedes Benz in Seattle WA on 2/16/15. Manufacturer date is 7/4/2014.

    Before purchasing I saw few marks on top, but salesman said that its just a stain. They tried to clean it. I told them more then couple time about stain, mildew smell, navigation screen blinking and then turns off, some code beeping, I literally took this van many times to dealership with all sort of problems but the salesmen convinced me that its just a stain and everything is working fine. { I even have proof of the complain}. My Sprinter was always kept in the garage when not in use, so i could not say anything before. but when I bought new car and 2015 Sprinter was outside for one year and now I got this big gush with the mildew smell and two rows of seats, floor and speakers flooded in this mildew water.

    I called my insurance to see if they will cover it, they said that it’s normal ware, I need proof that its not normal ware (to get proof that it’s not normal ware and tear I need to pay $125 per hour for up to 8 hours out of my pocket and then maybe insurance will cover it). Took it to Mercedes of Seattle they said that they don’t deal with these type of repairs, so I need to take it to auto shops that do these leaks repair. Who will pay for the repair course I need to pay for the repair. Pretty much they sold me vehicle that had too many problems in the beginning. I saw that there was lawsuit on 2014 model but maybe there is 2015 lawsuit?

    I am asking anyone to help with with this problem.

      maybe we should all sit in front of the dealerships with signs

        I have a 2015 with roof air – I live in SoCal and we had a period where we had very little rain so I didn’t notice the leakage problem for awhile. When I did took it to MB, warranty had expired, they wanted $1700. for the repair. I took it apart and repaired it myself. There was a flimsy foam seal that was broken and twisted at each corner. I haven’t talked to anyone who has the roof air that has one that doesn’t leak. What a shame for such a nice van. I have pictures of the MB foam seal that came off my van as well as pictures of water leaking in if needed. Cost $250. to evacuate and capture the AC coolant and for the repair sealant. Add to that around 10 to 12 hrs labor pulling everything apart, cleaning and replacing. Hopefully another class action suit will happen.

    Just took delivery on a 2016 with only 14000 mi. Bad ac roof leak. The dealer, Bolton ford of lake Charles la. Never divulged this even though they new it leaked. They delivered it to me in n.c. And I didn’t think anything was wrong until it rained. Do I have any recourse? Help!

      a lot of pissed off people about the same issue . please post any new info . i called the law firm that handled the last settlement .at the top of this site
