Mercedes-Benz USA LLC has agreed to settle a class action lawsuit over allegations its Sprinter vans have an air conditioning defect that causes the roof to leak.

If you owned or leased a 2010-2014 model year Mercedes-Benz or Freightliner Sprinter 2500 or 3500 with a rear air conditioning unit, your rights may be affected by this class action settlement.

If approved, the Mercedes class action settlement will resolve allegations that Mercedes distributed certain Sprinter vans equipped with rear air conditioning units that caused water to leak into the interior of the van.

The Mercedes Sprinter class action lawsuit asserts claims for fraudulent concealment, violation of California’s Song-Beverly Consumer Warranty Act, California’s Consumers Legal Remedies Act, California’s Unfair Competition Law and the New Jersey Consumer Fraud Act. The complaint also asserts fraud and warranty claims.

Mercedes-Benz denies the allegations and maintains that there is no defect related to the design or installation of the air conditioning units in its Sprinter vans. However, the car company has agreed to settle the Sprinter class action lawsuit to avoid the burden and expense of ongoing litigation.

Class Members who wish to exclude themselves from or object to the Sprinter air conditioning settlement must do so no later than June 16, 2016.

Who’s Eligible

Class Members of the Mercedes Sprinter settlement include all current and former owners or lessees of 2010-2014 model year Mercedes-Benz and Freightliner Sprinter 2500 or 3500 vans equipped with the original air conditioning unit. To be eligible for benefits from this settlement, Class Members must have purchased or leased their vehicles in the United States.

Potential Award

If approved, the Mercedes class action settlement will provide for an extended warranty on the A/C units, reimbursement for reasonable costs of repairs, and a modification to the maintenance service checklist to include an inspection of the allegedly affected vans’ roofs for water marks or other signs of water damage.

Extended Warranty: Mercedes will extend the warranty on the original-equipment rear air conditioning units in the affected vans for covered water leaks to the first seven years or 125,000 miles of the vehicle’s life (whichever occurs first). The extended warranty will also cover damage to the vehicle’s upholstery, headliner, or other original equipment parts that are damaged by warranty-covered water leaks. To receive this benefit, Class Members must bring their vehicles to an authorized Sprinter Service Center within the extended warranty period.

Reimbursement for Repairs: Mercedes has agreed to reimburse reasonable and necessary costs for repairs that would have been covered by the extended warranty period. To receive this benefit, Class Members must submit a timely and valid Claim Form, copies of repair orders or itemized invoices, and proof of payment.

Update to Maintenance Checklist: Under the terms of the Sprinter class action settlement, Mercedes will also modify the “Maintenance Service/B-Service Sheet” checklist to include inspection of the interior roof for water marks or other signs of water damage near the rear air conditioning unit in the allegedly affected vans.

Proof of Purchase

Class Members who are seeking reimbursement for repairs that took place during the extended warranty period must submit copies of repair orders or itemized invoices and proof of payment.

    My 2016 sprinter continues leaking everytime it rains, even if MB already worked on it two times. Now they want to charge me thousands of dollars. I hope we can open or re open another class action. Just for MB to address this issue.

    I took mine to the dealership with extended warranty. They said the leak wasn’t covered only the ac mechanism was covered. It was there for 2 weeks and they did not repair the leak.Dealer here in Melbourne Florida
