McGrath RentCorp agreed to a class action lawsuit settlement to resolve claims that it failed to prevent a 2021 data breach that compromised sensitive information.

The settlement benefits individuals whose personal information and/or protected health information was exposed to unauthorized access in the 2021 McGrath RentCorp data breach. 

Plaintiffs in the data breach class action lawsuit claim McGrath didn’t do enough to protect their information from hackers. As a result of subpar cybersecurity measures, third parties gained access to Social Security numbers, birth dates and protected health information, the class action lawsuit contends.

McGrath RentCorp is a business-to-business rental company that via five divisions: Mobile Modular, Mobile Modular Portable Storage, TRS-RenTelco, KitchensToGo and Enviroplex.

McGrath hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the data breach class action lawsuit.

Under the terms of the settlement, class members can receive up to $500 for non-economic losses and $5,000 for economic losses related to the data breach. In order to receive reimbursement, losses must be documented with various forms of proof.

All class members, even those who did not experience data breach losses, can receive one year of free credit monitoring and identity theft services from Equifax. These services include three bureau monitoring, fraud alerts and other benefits. 

The deadline for exclusion and objection is Nov. 6, 2023.

The final approval hearing for the settlement is scheduled for Feb. 2, 2024.

To receive settlement benefits, class members must submit a valid claim form by Nov. 6, 2023.

Proof of Purchase

No documentation is required for claims for non-economic losses.

Those submitting reimbursement claims of economic losses related to the incident must provide their name and current address; if applicable, a signed copy of IRS Form 14039 along with a statement, under penalty of perjury, that the form was submitted to the IRS; the bills or

invoices documenting the amount of the claim and proof the bills or invoices were paid; and a statement signed under penalty of perjury indicating the economic losses claimed are fairly traceable to the incident and the total amount claimed has not been reimbursed by any other person or entity.
