Whirlpool Corporation and Sears Roebuck and Co. have agreed to settle several class action lawsuits that allege certain front-loading washing machines are prone to developing mold or mildew. If you purchased or otherwise acquired a new Whirlpool, Kenmore or Maytag front-loading washing machine manufactured between 2001 and 2010, you may be entitled to compensation from the class action settlement.
The class action lawsuits allege that certain Whirlpool, Kenmore and Maytag front-loading washing machines don’t adequately self-clean after a wash cycle, leaving laundry residue that can result in a buildup of mold or mildew. As a result, consumers have reported that their machines emit a bad odor. Some consumers have reported that their laundry has been ruined.
The moldy washer class action lawsuits accused Whirlpool and Kenmore of negligence, breach of warranty and violations of various state consumer protection statutes.
The defendants deny any wrongdoing but agreed to settle the class action lawsuits to avoid the expense and uncertainty of ongoing litigation.
Class Members who wish to exclude themselves from or object to the front-loading washing machine settlement must do so no later than Aug. 9, 2016.
Who’s Eligible
Class Members of the front-loading washer settlement include “all residents of the United States and its territories who (a) purchased a new Class Washer, (b) acquired a Class Washer as part of the purchase or remodel of a home, or (c) received as a gift a new Class Washer not used by the donor or by anyone else after the donor purchased the Class Washer and before the donor gave the Class Washer to the Class Member.”
A list of eligible washer models is available here.
Potential Award
The Sears and Whirlpool moldy washer settlement provides several different benefits for Class Members to choose:
- A $50 cash payment (available only to certain Class Members who experienced a mold or odor problem within five years of purchase);
- A cash rebate of either 20 percent or five percent off the retail purchase price of a new washing machine or dryer; or
- Reimbursement of up to $500 for out-of-pocket expense for repairs or replacements due to a mold or odor problem.
Class Members may receive one benefit for each Class Washer they bought or acquired.
Proof of Purchase
Class Members may be asked to provide the model number, serial number and the purchase date of the washer. Class Members seeking reimbursement for paid replacements or repairs will be asked to provide additional documentation about their expenses.

I called the Settlement Administrator today. Actually, I pressed the number for the digital check department and the nice lady was very helpful. She asked for my name and then asked if such and such email address was correct for me and I said yes.
I didn’t think that they could look you up in the system but she did. She said that they had three $500 claims on file for me and that it was probably caused by refreshing the page??? She saw where one extra entry was already deleted and that the other would soon be too.
Anyway, she also said that they were working on my claim and that it would be emailed to my email address that she had verified earlier, by the end of this Fall!
My wife still doesn’t think that we’ll get the $500. We shall see.
I was emailed my $50 settlement check today.
Received my $50 check in my mail last Thursday.
I am do 2 $500 checks and i have emailed them multiple times first they said all checks will be out by august now they say soon i have received nothing. there must be protection for these companies defrauding the public no other in formation will be given totally absurd
Robert,
I’m due one $500 check and haven’t received it yet either.
On my most recent email replys, they say that 350,000 claims were made and that it would take time to get them all processed. This is crazy though. Will we have to do initiate class action lawsuit to get our money?
My wife is a CPA-External Auditor, so I know that everything that they asked for was included.
Even if it wasn’t, the Law office told me that they’d be in touch with me, so that I could make corrections.
Also, if you do choose to print option, I heard that you should do a screenshot and then print/deposit it that way. Receiving a check in the mail, or giving Check.IO your bank routing number isn’t working too well for most I’ve read.
Good luck
I never received notification in regards to this. Sears should of supplied them my information so I could either opt-in or out, correct?
I called and was told that due to the number of claims and how many individuals within a family filed a claim, all that had to be reviewed and the checks would go out in batches the next batch will be in August and the next batch after that will be 90-120 after that so this will literally be another year process in the distribution of checks !! And of course they can’t tell u where you are in the process.
I received my check. It was dated 04/21/17 for $50; however, my daughter has not yet received her check. I came back today (062417) to see how this worked out and if there was information on the final payouts. My daughter has questioned where here check is.
I requested a paper check rather than one directly deposited. However, the paper check never arrived. Is this a legitimate settlement?
I received a card in the mail notifying me this class-action lawsuit June 2016. We have had a problem with mold/smell from our Whirlpool washer for years (purchased in 2006). So I gladly filed a claim online. I received an email on 4/21/17 with a digital check for $50. I printed the check, and then deposited it to my bank with my bank’s mobile phone app and it was posted to my account the same day. The seal on that washer developed a hole(s) in it a few years ago which caused water to constantly leak from it creating a lot of prevention/clean up. We did try replacing the seal once, but it rubbed so badly that we returned it and put the old one back on. Finally the leak got so bad that last fall we purchased a new LG front-loading washer & dryer which we love! No leaking, no mold, no bad smell! :)
I wrote the Administrator twice for updates as I submitted a timely claim with all the pertinent info from my Whirlpool front loader. Below is what I received from them regarding my 2nd inquiry on June 9th, 2017:
Thank you for contacting the Settlement Administrator for the Washer Settlement. The court has granted final approval of the Settlement. The first round of benefits has been sent out. Over the next several months, the distribution of settlement benefits to eligible Class members will continue on a rolling basis. Every few weeks another round of benefits will be sent out. We are doing this due to volume. As the distribution is random, there is no way to tell where you are in the queue. We expect the entire distribution to be finished by mid-to-late August. Please visit the settlement website at http://www.WasherSettlement.com for additional details regarding the settlement.
Thank you,
Settlement Administrator

We chose the check via mail due to the looks of the email. Seemed kind of fishy and wierd so we opted for the mail check on April 22. Still no check in the mail!!!
Heather or Kim,
Did you all ever get your checks? Also, were they for $50 or $500 please?
Just curious because I’ve heard nothing on my $500 check and we submitted every single item that they asked for. My wife keeps everything!
