Moldy washer class action settlement

Whirlpool Corporation and Sears Roebuck and Co. have agreed to settle several class action lawsuits that allege certain front-loading washing machines are prone to developing mold or mildew. If you purchased or otherwise acquired a new Whirlpool, Kenmore or Maytag front-loading washing machine manufactured between 2001 and 2010, you may be entitled to compensation from the class action settlement.

The class action lawsuits allege that certain Whirlpool, Kenmore and Maytag front-loading washing machines don’t adequately self-clean after a wash cycle, leaving laundry residue that can result in a buildup of mold or mildew. As a result, consumers have reported that their machines emit a bad odor. Some consumers have reported that their laundry has been ruined.

The moldy washer class action lawsuits accused Whirlpool and Kenmore of negligence, breach of warranty and violations of various state consumer protection statutes.

The defendants deny any wrongdoing but agreed to settle the class action lawsuits to avoid the expense and uncertainty of ongoing litigation.

Class Members who wish to exclude themselves from or object to the front-loading washing machine settlement must do so no later than Aug. 9, 2016.

Who’s Eligible

Class Members of the front-loading washer settlement include “all residents of the United States and its territories who (a) purchased a new Class Washer, (b) acquired a Class Washer as part of the purchase or remodel of a home, or (c) received as a gift a new Class Washer not used by the donor or by anyone else after the donor purchased the Class Washer and before the donor gave the Class Washer to the Class Member.”

Potential Award

The Sears and Whirlpool moldy washer settlement provides several different benefits for Class Members to choose:

  • A $50 cash payment (available only to certain Class Members who experienced a mold or odor problem within five years of purchase);
  • A cash rebate of either 20 percent or five percent off the retail purchase price of a new washing machine or dryer; or
  • Reimbursement of up to $500 for out-of-pocket expense for repairs or replacements due to a mold or odor problem.

Class Members may receive one benefit for each Class Washer they bought or acquired.

Proof of Purchase

Class Members may be asked to provide the model number, serial number and the purchase date of the washer. Class Members seeking reimbursement for paid replacements or repairs will be asked to provide additional documentation about their expenses.

UPDATE 2: On September 28, 2016, an appeal to the moldy washer settlement was filed.  Claims will not be paid until all appeals are resolved.  Please keep checking Top Class Actions for updates.

    I have a Kenmore front loading washer I got in 2010 that has all of the issues they mention but my model is not on the list. Can I file anyway?

    What about the LG’s? I bought mine in 2005 and it to smells like mold. I’ve tried everything and nothing works to get rid of the mold smell. I’ve had to by new cloths because of this problem. I can’t afford to buy a new one. Please let me know if we can be included in this settlement. Tami P.

    I filled out the claim form and closed it out, but there was no confirmation, it just me to a page stating if I want to file a claim start here.. I did it again with the same result, no confirmation – anyone else have this happen to them???

      Yes. I also had this happen… I emailed the administrator but haven’t heard whether or not this is typical. I will post an update if/when I get a response.

    I HAD ONE AS WELL. AFTER ABOUT 3YRS I NOTICED A SMELL FROM THE WASHER,I THOUGT IT WAS THE TOWELS I HAD WASHED FOR MY CAR.I NOTICED ON THE NEXT LOAD OF CLOTHES THE SMELL WAS STILL THERE. A FOUL SMELL

    I have the same problem with the LG I purchased from Conns in 2011, there need to be some type of recall on those washers or class action suite. I spent over $1000.00 with the pedestals. We used front loading washers at the laundry/dry cleaners and never had this type of problems, something needs to be done.

    I had a Frigidaire GLTF2940FS that I had to just get rid of because of the smell. Plus it would rip your clothes.

    This lawsuit should NOT be limited to just the Whirlpool Front-Loading washers. What about their JUNK top-loading washers and JUNK dryers too? I bought both of these pieces of CRAP brand new in 2006 and by 2008 BOTH of these pieces of JUNK had quit working. This lawsuit should apply to ALL of Whirlpools raggedy, lousy, JUNK washers and dryers!!

      I have the same problem,the outside shell like brand new the inside 50 yrs old,fighting mold and mildew. I never had that problem with a washer before,and the Dryer is crap also.

      what a joke, we filed ours several weeks ago, before the deadline and today it was returned stating time had expired and lawsuit is now closed these guys are a joke, my sis has her top loading and it caught fire, now what.. just like the cell phones, no one gives a flying rats behind.

    What about the LG Front Load Washers, I have mold and odors as the above washers mentioned in this lawsuit. I purchased my LG washer from Sears and the mold and Odor is terrible. I purchased mine on April 1, 2008. I called Sears and they said they had several washers on sale if I wanted to purchase another one if I wasn’t happy with the LG. Do they think a person that is on Social Security can just go up and buy a new appliance anytime???? I hope there will be a class action suite against LG Electronics for the same as this lawsuit.       I agree with Wanda…..I have an LG as well with the same issues and I bought it January 2009…..I bought it from Lowes and they are not willing to do anything except advise on leaving the door open. After spending nearly a 1000 on the set I should not have smelly clothes and should not have to leave the door open. I will NEVER buy another front loader. Becky Burcham

        hello Becky, it doesn’t matter where you purchased the pair, lowes hd, sears, etc. they all have the same smell after a while, when we took ours apart thinking it was something dead in the trap, omg the smell was awful and when the repair guy and took apart the front end of the washing machine it could have gaged a maggot, it almost knocked us over, the mildew had built up and all kinds of debris had been collecting, its fixed now but $300. later, weird thing is that when the guy took apart the drain pipe on the bottom of the machine there was items we never have even had in our home, all our kids are raised and gone, so it looks like we paid full price in 2008 for brand new machines from sears, but they had been returned little did we know?????????????????.

      I agree with Wanda and others. I purchased an LG Front Load Washer in 2008 from Home Depot. No one is interested in helping me. The machine became so nasty and stinky I’ve had to toss it into the garage and purchase another. Guess what! My new one is NOT an LG and certainly not a front loader….of any kind.
      Hopefully, a class action suit against LG will be offered. Evelyn Todd
