Job applicants have secured a $1.2 million settlement ending allegations that Maxim Healthcare did not properly inform potential employees that they would have a consumer report pulled as part of the application process.
Class Members include those who applied and got a job with the healthcare services company between May 5, 2009 and Aug. 27, 2012, who were also subject to a consumer report check by Maxim.
The Maxim Healthcare class action lawsuit claimed that Maxim violated federal consumer privacy protections when procuring employee background checks.
Specifically, Maxium violated the Fair Credit Reporting Act, according to the class action lawsuit. Under the FCRA, job seekers must be properly informed about background checks.
Further, if a company decides not hire or fire an employee based on information in their background check, the company must inform the job seeker of that decision and include a copy of the report.
Maxim, a large health and medical care staffing company, failed to provide proper disclosure to job applicants under the FCRA, according to the class action lawsuit.
Maxim denies that it violated the federal law, but agreed to pay $1.2 million to end the employee background check class action lawsuit.
Under the terms of the settlement agreement, the company will pay each Class Member a portion of the settlement amount based on the number of valid claims submitted.
In order to submit a claim, Class Members must provide the Claim ID number found on their Notice.
Class Members who did not receive Notice can either contact the settlement administrator or provide their name and address, as well as a copy of the background check authorization form they signed as a part of their employment agreement with Maxim on the Claim Form.
The deadline to object to or opt out of the Maxim Healthcare employee background class action settlement is June 4, 2019.
Who’s Eligible
Class Members include those who were employed by Maxim Healthcare between May 5, 2009 and Aug. 27, 2012. Class Members must have completed a background check authorization and release form. Additionally, Maxim must have obtained a consumer report on the Class Member before Aug. 27, 2012.

Where are y’all from? Me I’m in Tulsa Oklahoma. I have called and from everything that I read on the case the court hearing is over and there is about 500 of us and from my figures we should get anywhere from 1000 to 1500 a piece

The Settlement creates a $1,200,000 cash common fund. This is nationwide. I’m from Illinois. So I would Think there is a lot more then 500. I think $34.00 is good. I seriously thought we’d all be getting 34 cents. However I have never participated in a class action suit before

Its in the courts hands. Don’t count on a high payout with the layers getting about 300,000 that doesn’t leave much to be divided amongst all the claimants Only the court knows how many people filed. TIme will tell
