Job applicants have secured a $1.2 million settlement ending allegations that Maxim Healthcare did not properly inform potential employees that they would have a consumer report pulled as part of the application process.
Class Members include those who applied and got a job with the healthcare services company between May 5, 2009 and Aug. 27, 2012, who were also subject to a consumer report check by Maxim.
The Maxim Healthcare class action lawsuit claimed that Maxim violated federal consumer privacy protections when procuring employee background checks.
Specifically, Maxium violated the Fair Credit Reporting Act, according to the class action lawsuit. Under the FCRA, job seekers must be properly informed about background checks.
Further, if a company decides not hire or fire an employee based on information in their background check, the company must inform the job seeker of that decision and include a copy of the report.
Maxim, a large health and medical care staffing company, failed to provide proper disclosure to job applicants under the FCRA, according to the class action lawsuit.
Maxim denies that it violated the federal law, but agreed to pay $1.2 million to end the employee background check class action lawsuit.
Under the terms of the settlement agreement, the company will pay each Class Member a portion of the settlement amount based on the number of valid claims submitted.
In order to submit a claim, Class Members must provide the Claim ID number found on their Notice.
Class Members who did not receive Notice can either contact the settlement administrator or provide their name and address, as well as a copy of the background check authorization form they signed as a part of their employment agreement with Maxim on the Claim Form.
The deadline to object to or opt out of the Maxim Healthcare employee background class action settlement is June 4, 2019.
Who’s Eligible
Class Members include those who were employed by Maxim Healthcare between May 5, 2009 and Aug. 27, 2012. Class Members must have completed a background check authorization and release form. Additionally, Maxim must have obtained a consumer report on the Class Member before Aug. 27, 2012.

This is not going to be a settlement- If you divide what is left after the 300,000 attorney fees etc that will leave about 900,000
EXAMPLE- I have no clue how many people filed claims so below is a estimated guess
10,000 people filed claims- they would get 90.00
5000 would get 180.00
What was the final reward amount per person?
Any new updates yet
No one geaed back im calling at 9 did we win i atleast want 10 grand or 5 lol depending on how many ppl in the settlement
The settlement is 1…2 million NOT 12 Million. The attorneys get about 300,000 and cost. We may get 15-50 dollars.
So court date has come and go! When do we know what happened?
Has anyone heard what happened today in court?
We will all be rich by next month ??
I sent in my card but I did not get a reply saying that they have received it am I in this class action
We probably will only get a couple of dollars, because they are trying to settle only 12 million. There could be 12 million of us that sent our cards in. I think they should give us all one million dollars.
You should definitely be thr judge in this case! Like you ❤
How many people are in the class action ?
I got the card and filled it out awhile back. Does anyone know what we do next. It said I was eligible to be in the suit and they would determine how much I would be reimbursed but have never seen a check.
I also filled out my card and waiting for response
I emailed them and it goes to court Aug 22nd and then they will decide if it’s fair.
1.2 million
The final hearing is 8/22/19 everything will be determine after that.
