Mattress Firm agreed to a $4.9 million settlement to resolve a class action lawsuit claiming Bed Tech bed frames are defective and dangerous.

The settlement benefits consumers who purchased an HR Platform bed frame sold under the Bed Tech brand name with model numbers HR33, HR33XL, HR46, HR50, HR60 or HR66 between April 8, 2015, and April 8, 2021.

Plaintiffs in the Mattress Firm class action lawsuit claim that Bed Tech bed frames are prone to collapse — leading to serious injury or even death. Manufacturer Global Home Imports recalled the products in March 2021 after 100 reports of frames collapsing. 

Bed Tech is a mattress and bed frame brand sold at a number of retailers, including Mattress Firm.

Mattress Firm and Global Home Imports haven’t admitted any wrongdoing but agreed to a $4.9 million class action settlement to resolve the defective product allegations.

Under the terms of the Mattress Firm class action lawsuit settlement, class members can receive either a cash payment or a gift card. 

Cash refunds are available to consumers with proof of purchase who return their bed frame to a Mattress Firm store within two years. Refunds will range from $73.98 for twin XL frames to $115.68 for California king frames. 

Class members who do not return their bed frame can receive a $125 Bed Tech gift card.

Payment amounts and gift card amounts may be reduced on a pro rata basis if the number of claims exceeds the $4.9 million settlement fund. 

The deadline for exclusion and objection is May 4, 2023.

The final approval hearing for the settlement is scheduled for July 19, 2023.

In order to receive settlement benefits, class members must submit a valid claim form by Aug. 4, 2023.

Consumers who purchased an HR Platform bed frame sold under the Bed Tech brand name with model numbers HR33, HR33XL, HR46, HR50, HR60 or HR66 between April 8, 2015, and April 8, 2021.

    We bought a 2008 Lexus LS 460 from Herrin-Gear. We started having problems with the dashboard. It would tell us that the VSC and the engine light were coming on daily and needed to be checked by the dealer. The first thing we said was to call us before any work was done on the car because we didn’t want to put a lot of money into a 2008 car. We paid $4000.00 to have the car fixed. Before I could get home, (15 minutes for Herrin-Gear) the entire dash went out. We took the car back. We talk to the manager and head mechanic. The head mechanic told us that he told them to call and let us know that replacing the sensors wasn’t going to fix the car. It needed an EGR wiring harness which cost us another 2640.00. We had to take the car back the next day because it was stalling in the streets. The car wouldn’t accelerate. Our car was gone for over a month. We were finally offered a loaner after an entire month. HERRIN-GEAR LEXUS will never get any of my business again.
