A class action settlement has been reached over allegations that Mario Badescu Skin Care Inc. violated federal and state laws regarding the marketing and sale of some of its products by failing to disclose all of their ingredients. If you bought Mario Badescu Healing Cream or Control Cream at any time since Feb. 15, 2009, you could receive one or two $45 certificates from the proposed class action settlement.

Who’s Eligible

Class Members include all persons in the United States who have purchased Mario Badescu Healing Cream or Mario Badescu Control Cream since Feb. 15, 2009.

Mario Badescu will send a $45 Certificate to Class Members who submit timely Claim Forms. The certificate is good for $45 off the purchase of any Mario Badescu product at www.mariobadescu.com or service or product at Mario Badescu’s New York Spa. Class Members who purchased both Healing Cream and Control Cream since Feb. 15, 2009 are entitled to receive one certificate for their Healing Cream purchases and another for their Control Cream purchases, for a total of two certificates.

Proof of Purchase

Class Members must submit a valid Claim Form stating, under the penalty of perjury, that they purchased Mario Badescu Healing Cream and/or Control Cream for personal use and not for resale sometime after Feb. 15, 2009.

Case Summary

The Mario Badescu skin care product settlement will resolve a class action lawsuit (Wankyu Choi, et al. v. Mario Badescu Skin Care Inc., et al.) that allege Mario Badescu violated certain state and federal laws and consumer protection statutes by failing to disclose all of the ingredients used in the advertising, labeling or marketing of its Healing Cream and Control Cream products.

Mario Badescu denies any liability but agreed to settle the class action lawsuit to avoid the expense and uncertainty of litigation.

    PA. Got the email. Got 3 bottles of body wash and 3 bottles of hand cream for $48 with free shipping so it cost me $3. Applied the code no problem ordering online. They take paypal. Stocking stuffers for female relatives is done this year!!!

    call Mario badescu customer service at 1800-badescu and you can put your order through that way– that’s how I did it and it went through, but you have to call before 6 p.m. eastern standard time.

    I had the same problem when I triedvto use it online. Tried putting it in a a discount and a gift card but neither worked.

    Just talked to one of the lawyers and co counsel member, they just called on the phone. There have been several objections filed regarding the terms of the settlement. They don’t expect them to be heard until fall of 2015 but it could always happen earlier. Until then and if the judge denies the objections no certificates will go out. If you want to this is the number i was contacted at by the attorney Gerald S Ohn. 310- 407- 8655. Didn’t have any explanation on why the webpage was taken down but feel free to call him if you want to confirm the very long delay were going to have.

    I contacted one of the lawyers asking for information on whats going on and why the website was taken down. I will post the answer I receive shortly.

    This stinks! I registered and received my claim number. Still have product in my cabinet…All #’s & links are no longer valid. Our legal system at its best!

      Yes, it does stink; lawsuit settled and final hearing in April, yet it is December and not a word. Have left messages for Kayla, at Rust 507 333 4300, who has yet to return my calls possibly because I mentioned Mario Badescu and no one wants to touch that one.

      Spoke with Jennifer at Rust and she said that there was an appeal filed and therefore nothing can be done until further notice. When I asked why the Rust telephone number was taken down; she said they must have been ordered to by the client. Wonder what their celebrity consumer, Martha Stewart thinks of this.

    Rust loves it when people say they won’t bother because of them. Don’t give them the satifaction. I filed anyway. you never know what will happen so just apply and hope for the best.
