If you purchased goods or services with a credit or debit card from a MAC store in Massachusetts between Nov. 5, 2009 and Oct. 9, 2015 and the clerk requested your ZIP code, you may be entitled to benefits from a class action settlement.

The proposed MAC Cosmetics class action settlement will resolve allegations MAC violated the Massachusetts Unfair Trade Practices Act by requesting and recording customers’ personal information, including their ZIP code, at the point of sale at MAC locations in Massachusetts.

According to plaintiff Lauren Miller, MAC employees asked for ZIP code information under the pretense that the information was necessary to complete their credit card transaction, but in reality the cosmetics retailer would use customers’ names and ZIP code data to identify the customer’s address using commercially available databases. The MAC class action lawsuit brought charges of unjust enrichment and violations of the Massachusetts Unfair Trade Practices Act.

MAC denies any wrongdoing but agreed to settle the ZIP code class action lawsuit to avoid the cost of trial. Under the terms of the MAC ZIP code settlement, Class Members will be eligible to receive a MAC gift card.

Class Members who wish to object to or opt out of the MAC ZIP code class action settlement must do so no later than Jan. 29, 2016.

UPDATE: On May 18, 2016, Top Class Actions readers who submitted a valid claim for the MAC class action settlement began receiving store gift cards worth as much as $34.10.

Who’s Eligible

You are a Class Member of the MAC ZIP code settlement if:

  • You used a credit or debit card to purchase goods or services from a MAC retail store (either in person or by phone) in Massachusetts between Nov. 5, 2009 and Oct. 9, 2015; and
  • A MAC employee requested your ZIP code in conjunction with the payment card transaction (unless the information was requested in connection with membership in a MAC program).
Potential Award

Class Members who file valid and timely claims will be eligible to receive a MAC gift card. The value of the gift card will depend on the total number of approved claims.

Proof of Purchase

Class Members must attest that a MAC employee asked for and recorded their ZIP code in conjunction with a payment card transaction between Nov. 5, 2009 and Oct. 9, 2015. Class Members must also attest that they have never been a member of the MAC Pro Membership Program, MAC Pro Student Program, or Back to MAC Program.

    im asking the same questions as everyone else. from what i KNOW, 300,000 dollars was put into this settlement. they were expecting 10k claims which would have wound up being about 30 dollars a claim, i read somewhere there were 86k claims! divide 300,000 by 86000 = 3.48 a piece. almost insulting.

    I got one yesterday – May 18, in Connecticut (for purchases made while in my neighboring state of Massachusetts). The trouble is I do not know how much it is worth. How can one find out? I do not want to make a special trip to a MAC store unless it is worthwhile. The card expires Dec. 31 of 2016.

    GOT MY GIFT CARD TODAY, BUT DONT KNOW HOW MUCH IS ON IT. ARE WE JUST SUPPOSE TO TAKE IT IN TO THE STORE AND 1.00 MAY BE ON THERE??????

    Called the number on back of card the man on the line says the card cannot be used or balance cannot be found without a pin number which most gift cards have on the back that you scratch off.GREAT

    Received mine today but no idea for how much! Googling the settlement has shown me nothing and the MAC website requires a PIN for the gc and the awarded gc doesn’t provide a PIN. baffled ?
