Lumber Liquidators has agreed to pay $36 million to settle multidistrict litigation involving allegations that some of its Chinese-made laminate flooring contained excessive levels of formaldehyde and that its flooring was not as durable as the company promised.

If you purchased Chinese-made laminate flooring sold by Lumber Liquidators between Jan. 1, 2009 and May 31, 2015, you may be entitled to benefits from the laminate flooring class action settlement.

The proposed Lumber Liquidators settlement will resolve two lawsuits, one of which alleged the Chinese-manufactured laminate flooring contained excessive formaldehyde levels and the other alleging the flooring failed to meet the industry standards for durability and scratch-resistance.

The plaintiffs claim that Chinese-made laminate flooring sold by Lumber Liquidators contained a dangerously high level of formaldehyde that made it unsuitable for use in a residence. They also claim that the flooring failed to properly adhere to the surface to which it was applied, causing it to buckle.

Lumber Liquidators was hit with more than 100 lawsuits following a March 2015 broadcast of “60 Minutes” that revealed Chinese-made laminate flooring sold by Lumber Liquidators allegedly contained six to seven times the amount of formaldehyde allowed under U.S. law.

Formaldehyde is a carcinogen, and exposure to the substance can cause headaches, nausea, and/or irritation of the eyes, nose and throat.

Lumber Liquidators denies the allegations but agreed to settle the laminate flooring class action lawsuit to avoid the expense and uncertainty of litigation.

The Lumber Liquidators laminate flooring settlement received preliminary approval in June 2018.

Class Members who would like to opt out of or object to the Lumber Liquidators settlement must do so no later than Sept. 4, 2018.

Class Members who belong to both the Formaldehyde Class and the Durability Class may submit claims for both benefits. NOTE: Settlement awards will be allocated on a pro rata basis depending on the total number of approved claims and the type of claims submitted.

I purchased KM High Sholes Hickory 12mm on 3/26/2014. I have the receipt but I can not find a box with it saying where it was made. On the receipt it has the product # 10026380/12HS/1072. So I don’t want to perjury myself, but I’d like to know if what I purchased was made in China, since it is suppose to have a 30 year warranty.

  10. Sharon Styles says:

I find it weird that Laminate sent out kits to test for formaldehyde, and determined none was on our floors, yet I hired a company and the levels went through the roof. This company should be ashamed and closed, for lying to its consumers and putting our health at risk. My son has asthma and had I known these floors were not safe, I would have NEVER!!!! INSTALLED Them!!!!!

Then a year later, I receive a post card in the mail, advising me I am a part of this settlement. They knew years prior this flooring was not safe and it should have been removed or replaced, right then and there. But they linger this stuff on, until it kills someone for them to correct their wrong doing. It make me sick at my stomache how so many corporations are allowed to kill innocent people.

    1. Vivian Davidson says:

Boycott ALL China tixix goods, particularly plastic in children’s toys

    2. Charles Hoelzer says:

Can we I ask what company you hired to do testing? I want to do the same.
