A $5 million settlement has been reached to resolve class action lawsuit allegations that Lenny & Larry’s misrepresented the nutritional value of their Complete Cookie.
Of the total settlement fund, $1.85 million would contribute to cash payments for Class Members and the remaining $3.15 million would provide free products to Class Members.
Class Members eligible for the Lenny & Larry’s settlement include consumers who purchased one or more packages of The Complete Cookie or other Lenny & Larry’s baked goods before March 19, 2019.
The Lenny & Larry’s class action lawsuit claimed that The Complete Cookie was inaccurately labeled in violation of federal law.
The plaintiffs alleged that the fat, sugar, carbohydrate, calorie and protein count were misrepresented.
According to the Lenny & Larry’s Complete Cookie class action, testing revealed that the cookie’s protein content was far below what the label advertised as having 16 grams.
In addition, the plaintiffs argue that the quality of the protein within The Complete Cookie was “intentionally miscalculated.”
The Lenny & Larry’s Complete Cookie class action states that “consumers pay an inflated price for the Product, which delivers less actual and quality protein than they reasonably expect to receive.”
According to the Lenny & Larry’s class action settlement, if Class Members submit a valid claim form including proof of purchase before Jan. 29, 2019, they have the option to receive either a cash payment or free product.
If Class Members opt for a cash payment, they will receive between $20 and $50. If they opt for free product, they will receive up to $30 of free cookies.
If Class Members submit a valid claim form by the deadline but lack proof of purchase, they can still recover a cash payment or free product, but the value may be lower. These Class Members can collect up to $10 in a cash payment or up to $15 of free cookies.
According to the class action settlement, proof of purchase is required for a larger payout because Lenny & Larry’s sells their cookies at numerous retailers. This means that they do not always have the contact information of their customers nor do they have complete records.
Lenny & Larry’s has also agreed to cover attorneys’ fees, court costs, and plaintiff awards. Plaintiff attorneys plan to ask for $1.2 million in attorneys’ fees and court costs. Each named plaintiff will receive a $1,500 award under the terms of the class action settlement.
UPDATE: On Feb. 15, 2019, the U.S. government urged an Illinois federal court to reject a $5 million settlement that would provide free cookies to Class Members affected by the alleged false labeling of Lenny & Larry’s The Complete Cookie.
UPDATE 2: On April 2, 2019, Lenny & Larry’s and a group of customers seek approval of a modified $2.3 million class action settlement that will provide more cash and free cookies to Class Members.
UPDATE 3: On Sept. 22, 2019, Top Class Actions viewers started receiving checks in the amount of $14.60 and three free cookies related to a $5 million Lenny & Larry’s class action settlement. Congratulations to everyone who filed a claim and got PAID!
Who’s Eligible
Consumers who purchased one or more packages of Lenny & Larry’s The Complete Cookie or other Lenny & Larry’s baked good products at a retail establishment or online before March 19, 2019.
Potential Award
Up to $50 with proof of purchase, up to $10 without proof of purchase, or free packages of The Complete Cookies.
Proof of Purchase
Not required but may qualify Class Members for a higher tier of compensation.
