LabCorp has reached an agreement to pay $11 million in a class action settlement to resolve claims that the laboratory services company willfully violated the Fair and Accurate Credit Transactions Act (FACTA) when they allegedly printed electronic debit card and credit card receipts that included credit card expiration dates.
Under the Fair and Accurate Credit Transactions Act, companies are required to truncate credit and debit account information on electronically-printed customer transaction receipts. To remain in compliance with FACTA, businesses must put no more than the last five digits of a credit or debit card account number on the receipt, and may not put any portion of the expiration date on the transaction record.
LabCorp has denied any wrongdoing with respect to the claims brought against the company. Both the lead plaintiff in the class action lawsuit and LabCorp agreed to settle the matter to avoid the costs and risk associated with having the case go to trial.
If you would like to request to be excluded from the LabCorp FACTA class action settlement, you must send in your exclusion request by mail with a postmark no later than Jan. 19, 2016.
UPDATE: According to one of our Top Class Actions readers, Class Members should expect to receive a LabCorp FACTA settlement check soon!
In an email correspondence, the Claims Administrator allegedly wrote: “The Settlement was approved at the Final Approval Hearing on February 16. The time during which an Appeal could be filed has passed, so the Settlement is finalized. The Claims administrators are currently working on processing the claim forms and settlement funds.The current estimate is that checks will be mailed to all qualifying claimants within the first week of May.”

Who’s Eligible
Class Members of the LabCorp FACTA class action settlement include:
“All individuals in the U.S. who: (i) made a payment at a LabCorp patient service center or equivalent (ii) using a debit or credit card, and (iii) for which LabCorp printed a point of sale receipt (iv) that displayed the card expiration date (v) between July 6, 2012 and November 4, 2015.”
Potential Award
Approximately $200.
The total amount of the settlement is $11 million.
The exact amount each Class Member receives will be determined by the number of valid claims that were submitted on time. It is estimated that each claimant will receive $200; however, the actual amount issued to Class Members may be higher or lower than this amount. All of the funds will be paid out to eligible claimants, and no portion of the settlement fund will be returned to LabCorp.
Proof of Purchase
If LabCorp’s records indicate that you may be a member of the settlement class, you will receive a postcard describing the settlement and stating a claim number for you to enter in your claim submission online or by mail.
If you believe you are eligible for the claim and have not received a postcard, you may still file a claim, or you may contact the settlement claims administrator below for additional assistance.

I have never received a check. The company did do a lot of my lab work
I never received a check.
I received a check for $179.44 on 5/9/16 (void after 9/2/16) and an additional check for $10.37 on 12/5/16 (void after 3/31/17). “The reason for this supplementation is that some of the original settlement distribution remain unclaimed, and so those funds are being redistributed to you and the other person who cashed their original settlement checks.”
