Consumers whose information may have been compromised during a Kroger Accellion file transfer appliance (FTA) data breach could be eligible for a payment of up to $5,000 thanks to a recent class action lawsuit settlement.

The Class is made up of those who received a notice from Kroger that their personal information was compromised as a result of the FTA data breach.

Plaintiffs in a class action lawsuit claim Kroger failed to adequately protect their information and, as a result, they were injured by the data breach.

Kroger announced the December 2020 breach in February 2021, saying an unauthorized user had accessed the personal information of Kroger pharmacy and money services customers, as well as that of current and former employees. This information included names, Social Security numbers, birth dates, insurance information, medical history, and more.

Kroger has not admitted to any wrongdoing, but has agreed to the settlement.

Accellion FTA is a file-transfer product that offers data protection, secure file sharing, and other features, according to Kiteworks.

Kroger has confirmed it is no longer using Accellion FTA.

The Kroger data breach settlement allows Class Members to claim one of the following benefits:

  • A cash payment in an amount to be determined
  • Two years of credit monitoring and insurance services
  • Cash payments of up to $5,000 per Class Member for reimbursement of certain documented losses

The cash payment will vary depending on the number of claims filed, but is expected to be an estimated $36 to $182 for California Class Members and $18 to $91 for all others.

Documentation is not required for cash fund payment claims.

The option for credit monitoring and insurance services includes up to $1 million in identity theft insurance coverage, credit monitoring from three bureaus, a customer care and dedicated fraud resolution agent, educational services, and extended fraud resolution, the total value of which is estimated to be $360.

Documented losses consist of unreimbursed losses incurred on or after Dec 16, 2020, related to identity theft and fraud and that were likely a result of the Kroger data breach. These losses can include credit card cancellation fees, decline payment fees, overdraft fees, costs associated with purchasing credit reports, and others.

A final fairness hearing in the Kroger FTA data breach class action lawsuit settlement is scheduled for March 10, 2022.

The deadline for Class Members to exclude themselves from or object to the settlement is Feb. 18, 2022.

The deadline to file a claim is March 5, 2022.

Class is made up of those who received a notice from Kroger that their personal information was compromised as a result of the File Transfer Appliance (FTA) data breach.

No proof of purchase necessary, but documentation may be needed for highest payout.

    I want to know why no checks have been sent out. I should have gotten my own lawyer. Because my bank account was hacked. Because you guys waited a whole year to contact me to even let me know all my information had been hacked. I want to know where are the checks. This is bs. I bet that lawyer got his attorney fees.
