Kroger Accellion Data Breach Class Action Settlement Overview:
- Why: The settlement follows several lawsuits regarding the breach of Accellion’s data systems, which Kroger uses to store customer information.
- Who: Kroger reached a settlement with class action consumers.
- Where: The class action settlement is pending in California federal court.
A California federal judge has preliminarily approved Kroger’s $5 million settlement with consumers over a breach of its software vendor Accellion’s systems that exposed the personal information of over 3.82 million Kroger customers.
The settlement is the result of several class action lawsuits filed against Kroger in California, Indiana, and Ohio, after Kroger announced in February that its money services and pharmacy customers might have been affected in the Accellion data breach. Claims against Accellion are not resolved in this settlement.
Kroger Data Breach Class Action Settlement
US District Judge Edward J. Davila’s initial approval gives the green light for cash payments to be made to those who submit valid claim forms within 90 days. Non-California residents can receive around $91 and California residents can receive $181. Claimants can also receive reimbursement of any documented losses up to $5,000 and two years of credit monitoring and insurance services.
The settlement Class includes United States residents who were informed by Kroger that their information might have been compromised, excluding Kroger employees and others.
The deal also requires Kroger to monitor the dark web for five years for fraudulent activity made with its customers’ exposed information. Kroger must also strengthen its risk management program.
In a separate order, Judge Davila rejected an objection motion by a group of Ohio litigants who argued the settlement was inadequate and provided no real relief or changes.
