Kellogg Sales Co. has agreed to a $13 million Settlement benefiting consumers who purchased certain Kellogg cereals labeled “heart healthy” or “lightly sweetened.” The Kellogg class action lawsuit alleged Kellogg violated certain laws by labeling three of its cereals with certain nutritious statements even though plaintiffs alleged the products contained excessive amounts of sugar.

The nationwide Kellogg class action Settlement Class is made up of anyone in the U.S. who, between Aug. 29, 2012, and May 1, 2020, purchased one of the Class Products in the United States, for household use and not for resale. The Class Products covered by the Settlement are: 

  • Kellogg’s Original Raisin Bran and Kellogg’s Raisin Bran Crunch cereals in a package stating “heart healthy”
  • Kellogg’s Smart Start Original Antioxidants cereal in a package stating “heart healthy” and/or “lightly sweetened”
  • Kellogg’s Frosted Mini-Wheats Bite Size (Original, Maple Brown Sugar, Strawberry, or Blueberry varieties), Big Bites (Original variety), Little Bites (Chocolate or Cinnamon Roll varieties), or Touch of Fruit in the Middle (Mixed Berry and Raspberry varieties) cereals in a package stating “lightly sweetened”

The company has denied all the accusations against it, and the Court has not ruled in favor of either party. 

Both sides have agreed to the Kellogg class action Settlement to avoid the costs and risks of litigation.

Class Members who submit a valid claim will receive a payment based on the type and amount of Class Products they purchased during the Class Period.

Claims are limited to two boxes per month of Raisin Bran and Frosted Mini-Wheats, and one box per month of Smart Start unless the Class Member submits proof of purchase.

There is no limit for claims that include proof of purchase. 

It is estimated the average award will be about $16.09; however, the actual amount of each Class Member’s award will depend on the number of claims made and the purchase history of each claimant. The final amount of each payment could be more or less than estimated.

In addition to the monetary relief, Kellogg also has agreed to certain injunctive relief related to the claims the company makes on the Class Products’ labels.

A final hearing in the Settlement is scheduled for Nov. 18, 2021.

The deadline to opt out of or object to the Settlement is Sept. 7, 2021.

Claim Forms also must be submitted by Sept. 7, 2021.

Who’s Eligible

Potential Award

Proof of Purchase

Receipts, purchase orders, invoices, or other documentation indicating the product that was purchased, as well as the date of purchase and the quantity purchased.

  • There is no limit for claims that provide proof of purchase.
  • There is a limit of two boxes per month of Raisin Bran and Frosted Mini-Wheats, and one box per month of Smart Start for claims submitted without proof of purchase.
  • Failure to provide sufficient proof of purchase may result in your claim being subjected to the one-box-per-month product cap for Smart Start and/or two-box-per-month cap for Raisin Bran and Frosted Mini-Wheats, or in the claim being denied.

    Why do I only receive a check for very few cases I sign up for? Spending all that time filling out claim forms is hardly worth it when I only get maybe one check out of every six cases I apply for.

    You have to submit a claim via the website listed. The claim date has expired anyways but for future reference you have to submit a claim for any settlements on this page. You can’t just say add me. Each one will give you instructions on how to submit a claim.
