Kellogg False Advertising Settlement Payments
Top Class Actions readers have reported receiving PayPal payments of up to $31.32 from a Kellogg false advertising class action lawsuit.
The false advertising settlement benefited consumers who purchased certain Kellogg cereals between Aug. 29, 2012, and May 1, 2020. Cereals in the settlement include Raisin Bran, Smart Start, and Frosted Mini Wheats.
According to the Kellogg false advertising class action lawsuit, these cereals werf falsely advertised as “heart healthy” and “lightly sweetened.” Despite these claims, Kellogg cereals allegedly contain high levels of added sugars.
Kellogg didn’t admit any wrongdoing in the case but agreed to settle the claims with a $13 million settlement.
Under the terms of the settlement, Class Members could recover a payment based on the number of products purchased and if claimants provided proof of purchase. Payments were estimated to be $16.09, though our readers report receiving higher payments of up to $31.32.
In order to receive a payment, affected consumers had to submit a valid claim form by Sept. 7, 2021.
The settlement Class is represented by The Law Office of Jack Fitzgerald PC and Jackson & Foster LLC.
The Kellogg Class Action Lawsuit is Stephen Hadley, et al. v. Kellogg Sales Co., Case No. 16-cv-4955-LHK in the U.S. District Court for the Northern District of California.
Amtrak ADA Class Action Settlement Payout Checks
Our readers have received checks worth up to $2,500 from an Amtrak ADA settlement.
The settlement benefited mobility-impaired individuals who encountered access issues at certain Amtrak stations between July 27, 2013, and Dec. 2, 2020.
According to a class action lawsuit against Amtrak, the transportation company violated federal law by failing to make it’s stations accessible to consumers using wheelchairs or other mobility aids. These access barriers allegedly violated the federal ADA — a law requiring businesses to provide equal access to consumers with disabilities.
Amtrak agreed to settle these ADA claims with a $2.25 million settlement.
The settlement included non-monetary relief, such as accessibility changes to Amtrak stations going forward.
The deal also provided cash payments to affected consumers. Payments were expected to vary depending on the barriers encountered.
TCA readers have reported payments of up to $2,500 from this settlement.
In order to receive a settlement payout, Class Members had to submit a valid claim form by May 29, 2021.
The ADA settlement Class is represented by federal legal authorities including the Department of Justice and United States Attorney General.
The Amtrak ADA Class Action Lawsuit is United States of America v. The National Railroad Passenger Corp. (Amtrak), Case No. 1:20-cv-03505 in the U.S. District Court for the District of Columbia.
