Tween Brands Inc. and Ascena Retail Group Inc., which operate Justice stores throughout the United States, have agreed to a $50.8 million class action settlement to resolve allegations that the retailer engaged in deceptive and misleading advertising. The class action lawsuit claims that Justice marked items “40% off” when the sale price was actually Justice’s regular retail price.
If you purchased merchandise from a Justice store between Jan. 1, 2012 and Feb. 28, 2015, you may be entitled to benefits from the fake sale price class action settlement.
The Justice defendants deny any wrongdoing related to the claims made in the fake sale price class action lawsuit. However, to avoid further costs and risks associated with litigation, Justice has agreed to the terms of the settlement to bring forth a resolution to the claims.
In addition to monetary relief in the class action settlement, Justice has also agreed to an injunction to halt the actions that were alleged in the claim. According to settlement documents, “Justice represents it ceased the persistent forty percent (40%) off everything sales, has changed its business model to reprice its merchandise and agrees to abide by all applicable sales laws with respect to price comparison and sale advertising.”
If you would like to request to be excluded from the Justice class action settlement, you must do so by April 20, 2016.
Who’s Eligible
Class Members of the Justice class action settlement include:
“All individuals who purchased merchandise from Justice during the period from January 1, 2012 through February 28, 2015, except for those who were eligible to be Class Members in an earlier class action against Justice in Ohio.”
“Ohio residents who purchased merchandise from Justice stores in Ohio between July 1, 2012 and August 31, 2014 are not included in this settlement because they were eligible to participate in an earlier settlement in the case titled Perez v. Tween Brands, Inc., No. 14-CV-001119, Court of Common Pleas, Lake County, Ohio.”
NOTE: If you were part of the Perez v. Tween Brands Inc. settlement but also made purchases at Justice between Jan. 1, 2012 and June 30, 2012, and/or between Sept. 1, 2014 and Feb. 28, 2015, you may submit a claim for this class action settlement.
Potential Award
Up to $20 cash or $30 Justice voucher without proof of purchase, more with proof of purchase
Option 1 (Claim with no documentation of Justice purchases): Up to $20 cash award or up to $30 Justice voucher based on state of residence. For a more detailed explanation of payment by state, a chart can be viewed in the Justice Settlement FAQ.
Option 2 (Claim with documentation of Justice purchases): Cash payment of 14% of your documented purchases or a Justice voucher for 20% of your documented purchase. There is no maximum cash payment if you have documentation of your purchases.
Proof of Purchase
In order to qualify for option 2, individuals are required to provide 1) documentation of 6 or more Justice purchases or 2) a single purchase at Justice totaling $105 or more. Documentation can be in the form of bank statements, credit card statements and/or Justice receipts.
No documentation is required for option 1.

UPDATE 3: On Sept. 21, 2017, Top Class Actions viewers who filed a valid claim for the Justice fake sale class action settlement started receiving checks in the mail worth as much as $175.48!

Although complications have slowed the process whereby vouchers are created and tested, the Parties fully expect to disseminate all vouchers to Class Members well in advance of the distribution deadline of November 28, 2017, which is 180 days after the “Effective Date” under the Settlement Agreement.
Does this also mean customers who submitted proof of payments via receipt and requested a check option will also receive their distribution?
It is taking a long time. My granddaughter is not wearing these clothes anymore. She is tall, so I have to buy her clothing in other stores. Anyways, I asked for a check, any idea when it will be solved?

There are 18 million vouchers that have to be distributed to claimants. It is not known at this time, how quickly the settlement administrator will complete the process of getting both vouchers and checks ready for distribution to claimants.

You are right, been to a Justice store lately. Their clothing line is ugly and very cheaply made. At this rate my grandaughter will be in college before we see any distribution. The grandaughter that I bought the clothing for won’t even go into the store and wears junior clothing now. My eight year old doesn’t like the brand. You think they already considered this???

Me, too!! Hope it’s resolved before my granddaughter is too old for the clothing! This is a bit ridiculous, especially for those of us who spent so much time gathering receipts so we could get the maximum reward!!
When I put in my receipts two years ago, both of my daughters liked the clothes there, so I opted for the store vouchers to get more ‘money.’ Now, 2 years later, one of my daughters isn’t interested in the store anymore. I’m hoping this finally settles before my younger daughter doesn’t want clothese there anymore either. Or can I switch my request from a store voucher to a check?
I got a confirmation on 3/3/16 and haven’t heard a word since.
