Interstate National Dealer Services Inc. has agreed to pay $4.2 million to settle a class action lawsuit that claimed the auto warranty company violated the Telephone Consumer Protection Act (TCPA).
Lead plaintiff Diana Mey filed the TCPA class action lawsuit after allegedly receiving a phone call from Interstate to her cellphone which was a number registered on the National Do Not Call Registry. Mey says that Interstate was attempting to sell her an extended warranty on her car and were in possession of her vehicle information (including her VIN number) regardless of the fact that she had never made an inquiry about a warranty.
Interstate maintains that it did not make any unsolicited telemarketing calls, or authorize any service providers to do so. However, they have agreed to the settlement to avoid the cost of further litigation.
Class Members who wish to “opt out” or object to the TCPA settlement must do so by Mar. 24, 2016.
Who’s Eligible
The Interstate TCPA class action settlement is open to all Class Members who received one (or more) solicitation calls from Interstate between June 12, 2010 and Jan. 28, 2016 to a phone number that was listed on the National Do Not Call Registry.
In addition, the TCPA settlement is also open to all Class Members who received a call from Interstate on their cell phone.

Interstate has agreed to establish a $4.2 million Settlement Fund. All Class Members who submit a valid and timely Claim Form will receive an equal portion of the settlement once the Court gives final approval.

Class Members must submit a Claim Form by Mar. 24, 2016 to receive a portion of the Settlement Funds. To complete the Claim Form, Class Members will be required to enter the phone number that received the calls related to this class action settlement.

The settlement administrator responded to my email. I asked when checks will be mailed and the answer was 9/17 (Sept 17th).
I received an response email from them on September 7th stating that the checks will be mailed in October. I would hope your answer is correct but I received the email after you.

There is no known timeframe for distribution. Generally speaking in similar cases like this one it takes about a year from the claims filing deadline (which in this case was March 24, 2016) before distribution takes place. Sometimes it can be quicker. Sometimes it can take longer. It all depends on how long it takes to finish the processing and auditing.

I received a check deposited it, then it was taken out (returned) and I was charged a $12 fee! Why?
60 days beyond the final hearing would be Aug. 7, 2016. These should be arriving in mailboxes soon.
I just received this a few days ago. Past the deadline and there is no one to talk at the number given. I want to participate but too late. Mailed to me late. Bob
Oh no, I JUST missed this by 2 days. I asked to be removed from their calling list every time, about 15 times, and still called me. I missed it? Oh nooooooo
yeh letters to , dmv sells your info they should be sued
There were days that I received calls about extending my auto warranty 6 or 7 times a day! One week alone, I counted 34 calls! They would start at 8 am and sone calls were made at 8:55 pm! My number was on the Do Not Call Registry. I am so happy this is coming to an end! As a care taker for my elderly father at the time, the disruptions were annoying and frustrating. Thank you for putting an end to all of this. ?
