Consumers who owned or leased certain models of Hyundai may be eligible for a reimbursement or warranty extension thanks to a class action settlement.

Anyone who owned or leased a Class Vehicle that was purchased or leased in the United States — including the District of Columbia, but excluding other U.S. territories — or those who purchased or leased a Class Vehicle while abroad on active military duty may be eligible to benefit from the Honda piston engine settlement.

Plaintiffs in a class action lawsuit had alleged certain models of the defendants’ vehicles had a defect that could cause engine seizure and stalling. 

The defendants deny these allegations and have not been found guilty in court, but have agreed to a settlement.

The following vehicles equipped with a 1.8L Nu engine are considered Class Vehicles:

  • Hyundai Elantra (model years 2011, 2012, 2013, 2014, 2015 and 2016)
  • Hyundai Elantra GT (model year 2013)
  • Hyundai Elantra Coupe (model year 2013)

The Hyundai piston engine settlement provides relief in the form of warranty extensions, reimbursement for past repairs, and reimbursement for expenses such as towing and car rentals.

Warranty Extensions

To qualify for an automatic warranty extension, a Class Member’s Class Vehicle must be registered in a “cold weather state” for at least six months.

“Cold Weather States,” a defined by the settlement agreement, are: Alaska, Colorado, Connecticut, Delaware, District of Columbia, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Maine, Maryland, Massachusetts, Michigan, Minnesota, Missouri, Montana, Nebraska, New Hampshire, New Jersey, New York, North Dakota, Ohio, Pennsylvania, Rhode Island, South Dakota, Utah, Vermont, Washington, West Virginia, Wisconsin, and Wyoming.

According to the settlement website, Class Members who live in a state not considered a cold weather state as defined by the settlement must submit a claim form in order to receive a warranty extension. They also must meet one of the following conditions:

  • After the notice date, you register your Class Vehicle in a Cold Weather State for at least six months
  • The Class Vehicle was previously registered in a  Cold Weather State
  • You demonstrate substantial prior cold-weather usage of the vehicle for at least 90 consecutive days from November to March during which the Class Vehicle was in a place where it was exposed to at least 50 cumulative days of temperatures at or below 32 degrees in that location during that period
  • You demonstrate, with a heightened proof submission (such as actual parts, photo, or other evidence) that the engine problem is directly related to the “piston-scuffing-type defect” alleged in the class action lawsuit.

Class Members whose vehicles were already beyond the time and mileage limits for extended warranties as of the notice date will have their powertrain warranty time and mileage limits extended for the 90 days following the Court’s final approval of the settlement in Cold Weather or Warm Weather states, (subject to the conditions previously mentioned). The mileage limit will be extended to 140,000 miles for original retail purchasers and lessees, as well as purchasers of Hyundai Certified Pre-Owned vehicles. The limit will be extended to 100,000 for all other owners.

The warranty extension may be denied for “Exceptional Neglect,” meaning failure to change the Class Vehicle’s engine oil for at least 365 consecutive days or 15,000 miles.

Reimbursement

In order to file a claim for reimbursement, Class Members with vehicles registered in Cold Weather States must submit a claim form that includes a proof of repair expense or repair-related expense. Hyundai must not substantiate Exceptional Neglect with respect to the repair.

Class Members whose vehicle is not registered in a Cold Weather State as of the notice date may also submit a claim form including proof or repair. These Class Members’ claim forms also must document that the vehicle was previously registered in a Cold Weather State, was previously subjected to previous cold-weather usage for at least 90 consecutive days between November and March in a location in which it was exposed to at least 50 cumulative days of below-freezing temperatures. 

The claim must also demonstrate through heightened proof submission that the repair was directly related to the alleged “piston-scuffing-type defect.”

The deadline to object to or opt out of the settlement is April 2, 2021.

The deadline to file a claim is 70 days after the Court grants final approval. The final approval hearing currently is scheduled for April 19, 2021, which would make the claim deadline June 28, 2021.

      Did they tell you when you would receive it or just wether it was approved. I put it in in July of 2020 and it’s been approved since March of this year but haven’t heard anything

      My claim was approved back in April and last week I went back on their website to check when the payment would be sent out and now it shows as denied. I sent an email to support@hmapistonsettlement.com to find out why the claim is now denied. I never received a notice or email that my claim was now denied.

        Yes that is the game that hyundai is playing. It seems that we have to get another class action law suit to get our claims that were approved and they are now trying to deny and not pay the claims. Monkey business 101. I will keep you posted after talking to some more attorneys and the news team. I called them September 8th, 2022 and they said that they have no documents of any claims

      I have a 2014 Elantra that had the piston slap. I took mine to the dealership. The diagnostic indicated piston slap. I received a new short block. No more issues.

        Hey Kathy, how many miles have you put on your Elantra since you got the new short block? I’m worried when I get my new engine the same thing will happen after 80K miles or so

    I purchased a 2014 Hyundai Veloster on Jan 29, 2020. I also bought an extended warranty from Keith Reiss. At the end of March, a year later, my engine went out, due to low oil the engine seized up. I took it to the Hyundai of Columbia, where it still resides. They gave me that diagnosis. My last oil change was on Jan 21, 2021. I have had three oil changes. After much research I find this type of car burns a lot of oil, and is known for low oil readings, according to carfax, and the Hyundai website. I have tried to use my purchased extended warranty but was denied for no oil changes. After proving and giving all my mechanical records, I was denied again for not have them done sooner. I did not find that anywhere in the contract, and I feel like I have got the runaround. I have called Keith Reiss, who sold this to me, and he finally called me back after several messages and emails. I ask him in April to cancel this warranty. I am also wanting a refund of all monies due. I have also spoken with AUL, and they told me to contact you again to handle this. They have advised me I am due money, and this should be handled through Nissan. Unfortunately, I have got nowhere with Mr. Reiss. My last recourse is to take this to court. Please help me get this resolved. I believe the Veloster should also be part of this claim. Thank you, Karen De Vose

    also i got one of the papers in the mail, and my vin says my vehicle is part of the lawsuit, is there anything i can do to get a new engine?

    i bought a 2012 hyundai elentra from a police auction. it didnt have a key so i wasnt able to check it out before hand. i got a key made , started it and it made a horrible knocking sound, tried to drive it across town and it stalled out on a busy street in the middle of the road! also when i was driving it would barely accelerate. i bought it a year ago and its been sitting in the driveway ever since, it has 125,000 miles on itor so , i think . not sure what i’m suppose to do with it.

    I have a 2013 model and I have taken it to several places to have it worked on because it just shuts off while I’m driving. After spending 2,000 dollars and getting no answer has made me so frustrated. If Hyundai knows this is happening in there cars and doesn’t even bother to contact anyone to let them know is unprofessional!!! Are they that greedy to risk the lives of others especially children!! I still haven’t had anyone to pin point the problem and it’s hard to trade it off when you can’t drive it for 15 minutes before it dies. I feel guilty to even put that on anyone! I will never buy a Hyundai again and I recommend to anyone else not to

      Go to a dealer. Hyundai just replaced short block engine on my 2014 Elantra no charge. It purrs like a kitten. Tick and Clack gone.

    I purchased my hyndia 2011 in June of last year 5000 dollars and I’ve had the oil changed new spark plugs tune up gasket and I haven’t put even 10,000 miles on it cause the ticking noise started it cost me almost 800 dollars not counting the ac went out 423.00 which doesn’t pertain to the engine but it’s B’s take these cars back alot of problems it’s unfair
