Humana and Cotiviti agreed to a class action lawsuit settlement to resolve claims they jeopardized consumer data in a 2020 data breach.

The settlement benefits consumers who received notification from Humana that their personal and health information was compromised in a data breach occurring between Oct. 12 and Dec. 16, 2020.

Humana is a health insurance company that suffered a large data breach in 2020 along with its analytics partner, Cotiviti. Between Oct. 12 and Dec. 16, 2020, Cotiviti allegedly disclosed personal identifying and health information to a subcontractor which, in turn, disclosed this information to unauthorized third parties. 

As a result, around 65,000 patients reportedly had their names, Social Security numbers, birth dates, addresses, phone numbers, email addresses, health information and other data compromised.

Despite learning of the breach in December 2020, Humana and Cotivi allegedly waited until 2021 to inform affected plan members of the issue. Shortly after, one plan participant took legal action against the companies.

According to the data breach class action lawsuit, the companies negligently failed to protect consumer data and failed to promptly disclose the breach to allow consumers to monitor their information for fraud. As a result of the breach, the plaintiff and class members will allegedly be at risk for identity theft and fraud for years, if not for the rest of their lives. 

Humana and Cotiviti haven’t admitted any wrongdoing but agreed to resolve these allegations with a class action settlement. The total settlement fund is not specified in the settlement agreement.

Under the terms of the settlement, class members can receive a maximum of $5,250 in payments for out-of-pocket losses. The settlement allows up to $250 for ordinary losses, such as fees, credit monitoring and three hours of lost time at a rate of $20 per hour. Class members can collect a larger payment of up to $5,000 for extraordinary losses, such as unreimbursed fraudulent charges and identity theft.

The settlement provides additional benefits in the form of two years of IDX credit monitoring and identity theft insurance. 

The defendants have also agreed to maintain vendor compliance policies to better protect consumer data. This increased security will provide equitable relief to class members.

The deadline for exclusion and objection is Nov. 15, 2022. 

The final approval hearing for the Humana and Cotiviti data breach settlement is scheduled for Feb. 8, 2023.

In order to receive benefits from the Humana and Cotiviti data breach class action lawsuit settlement, class members must submit a valid claim form by Nov. 15, 2022.

    Please add me, I have been a member/subscriber of Humana since I believe 2019 – present and was a member at the time of the breach. I do not know if I received a letter or not – my mail service has been unreliable for years, especially during Covid. We have had vast employee postal worker shortages in my area and I KNOW I am not receiving all of my mail for one reason or another? I could not find the FAQ section either to see if I was supposed to receive a letter like another person commented as well? Thank you.
