PCS Revenue Control Systems agreed to a $1.135 million class action lawsuit settlement to resolve claims it failed to protect consumers from a data breach.

The settlement benefits consumers whose personal information was compromised in a PCS Revenue Control Systems data breach between May 19, 2017, and Dec. 19, 2019. An estimated 867,2019 individuals are included under this class definition.

PCS Revenue Control Services offers technology and services for school cafeterias, catering and nutrition. The company acquired the previous vendor, Advanced Business Technologies.

In March 2021, PCS Revenue Control Systems revealed it had been the target of a data breach in 2019. The breach, which was discovered in December 2019, allegedly compromised the names, dates of birth, student ID numbers and Social Security numbers gathered by Advanced Business Technologies. 

Consumers took legal action against PCS, claiming it failed in its duty to protect their information through reasonable cybersecurity measures. Such measures would have allegedly prevented the breach.

The data breach class action lawsuit also challenges how long it took PCS Revenue Control Systems to notify consumers of the data breach. By waiting over a year to notify affected individuals, the company allegedly deprived consumers of the chance to proactively protect themselves from fraud and identity theft.

“Until notified of the breach, Plaintiffs and Class Members had no idea their [personally identifiable information] had been compromised, and that they were, and continue to be, at significant risk of identity theft and various other forms of personal, social, and financial harm,” the data breach class action lawsuit claims. “The risk will remain for their respective lifetimes.”

PCS hasn’t admitted any wrongdoing but agreed to resolve these allegations with a $1.135 million class action settlement.

Under the terms of the settlement, class members can receive a cash payment for data breach-related expenses. 

Each class member can claim up to $2,500 in expenses, including professional fees, credit repair costs, credit monitoring, other expenses and up to three hours of lost time at a rate of $25 per hour.

In addition, PCA Revenue Control Services agreed to make business changes to improve cybersecurity and better protect customer information. Under the data breach settlement, the company agreed to enhance employee cybersecurity training, restrict access to personal information, enhance system monitoring and more.

The deadline for exclusion and objection is Nov. 23, 2022. 

The final approval hearing for the settlement is scheduled for Dec. 20, 2022.

In order to receive benefits from the PCS Revenue Control Systems data breach settlement, class members must submit a valid claim form by Nov. 23, 2022.

    I need a lawyer that can sue laws firm for dropping me because lawyer that had my
    case made a mess left jan1 to be a margtete and then another lawyer in firm took or handed case,told me a big mess and went to a court and dropped me,now without lawyer,and Zurich American lawyer on other side dropped them and they have new this whole case needs to be investigated Now I’m going clipped
