Avalon Organics

The Hain Celestial Group Inc. has agreed to settle a class action lawsuit alleging it falsely represents certain cosmetic products as organic. If you purchased Avalon Organics or JASON brand cosmetic products, your rights may be affected by this class action settlement.

The class action lawsuit alleges Hain Celestial falsely sells, labels and/or represents some of its JASON and Avalon Organics cosmetic products as organic. These allegedly mislabeled products violate California’s Organic Products Act, which requires that products represented as organic consist of at least 70 percent organic ingredients, according to the JASON and Avalon Organics class action lawsuit.

The plaintiffs allege the packaging and advertising of some JASON and Avalon Organics products mislead consumers into believing that the products are entirely or mostly organic, even though they are not, according to the class action lawsuit. A Class was certified for the Hain Celestial class action lawsuit in November.

Hain Celestial denies the allegations. A trial was scheduled to begin on Aug. 6, 2015. However, Hain agreed to settle the class action lawsuit to avoid the cost and uncertainty associated with trial.

Who’s Eligible

Class Members of the JASON and Avalon Organics class action lawsuit include anyone who purchased Avalon Organics brand cosmetic products in California between May 11, 2007 and Jan. 6, 2015 (other than those that were USDA certified as organic) and/or JASON brand cosmetic products between May 11, 2007 and Jan. 31, 2011 (other than those that were USDA certified as organic).

Potential Award

Up to $80 in cash and coupons without receipts, or more with receipts.

Class Members who file a valid and timely Claim Form with receipts will be eligible to receive 50 percent of the purchase price for all of the challenged products purchased. You may choose to elect to receive your payment in cash only or you may choose a combination of cash and receipts. There is no maximum cash payment if you have receipts for your purchases.

Class Members who do not have receipts may receive up to $40 in cash plus $40 in coupons, or up to $50 in cash. Payment will be calculated at 50 percent of the purchase price for up to $100 worth of the challenged products purchased.

Proof of Purchase

You do not need to submit receipts if you are submitting a claim for $100 or less in purchases of the challenged products.

If you are submitting a claim for $100 or more in purchases of the challenged products, you must submit receipts.

    If total MSRP from eligible product list is over $100 you must attach receipts. This information is on the paper claim form. If you wont attach receipts and products MSRP will be over $100, you will get message: too many requests in 24 hours. My claim was submitted successfully without receipts with MSRP below $100 after updating prices for each product one by one.

    I get the same reply. Tried using different web browsers….no luck. Cleared history, cache, etc, tried again…..no luck. Attempted to file with spouses name instead of mine….no luck.

    The online claim form does not work. It keeps erring out and states too many requests in a 24 hr period, yet I have not actually been successful in submitting ONE. AND when you try to use the contact form on the settlement site, it comes back, Too many requests within a one week period.. So, this exercise was fruitless and frustrating…..
