General Information Services Inc. (GIS) has reached a class action lawsuit settlement over allegations it violated the Fair Credit Reporting Act when providing information for consumer background check reports. If you were the subject of a criminal background check report that contained information furnished by GIS, you may be eligible to claim approximately $40 or $1,500 from the class action settlement.
The GIS class action settlement resolves allegations that the background screening company provided reports that contained expunged criminal records (the “1681e Settlement Class”) or did not mail notices to consumers that GIS had reported public record information likely to have an adverse effect upon the consumer’s employment on the same day that GIS furnished the report to the end-user (the “1681k Settlement Class”).
The GIS background screening class action lawsuit claims that GIS violated the FCRA by allegedly, “a). Failing to notify consumer contemporaneously of the fact that adverse criminal record information is being provided to employers or prospective employers; and b.) Failing to maintain strict procedures to insure that the adverse information being reported is complete and up to date.”
GIS has denied liability, but according the background screening class action lawsuit, “nevertheless desires to settle the Plaintiff’s and Settlement Class Member’s claims solely for the purposes of avoiding the burden, expense, risk, and uncertainty of continuing the Litigation[.]”
The GIS class action settlement potentially affects anyone who applied for employment within the last two years and were knowingly or unknowingly subjected to a GIS consumer report.
Who’s Eligible
You are a Class Member of the GIS background check class action settlement if:
1) You applied for a job position where GIS provided your prospective employer with a background report containing an expunged criminal record between Dec. 22, 2009 and March 1, 2014, or if
2) You applied for a job where GIS provided a potential employer with a background check that contained information from public records, but you were not informed by GIS through a mailed notice on the same day, or not informed at all, that GIS provided an employer with the report between Dec. 22, 2009 and March 1, 2014.

$40 or $1,500
Proof of Purchase
N/A. Unless they voluntarily exclude themselves, eligible Class Members will automatically receive a GIS settlement check in the mail.
Claim Form Deadline
N/A Class Members will automatically receive benefits if the GIS class action settlement is approved, unless they exclude themselves by Sept. 4, 2014

Thank you for the optimism and the actual research… But honestly the negative comments were pretty entertaining. I did get the same info from GIS directly.
I called they said they don’t know the dollar amount yet but will be sending sometime in the beginning of next week

There is no way but once it’s a closed case it’s not really much one can dispute..Im sure the attorney invoveld has some worked up excessive payouts they can substantiate to eat way on any unpaid monies…They won off Individuals who encountered such an horrendous Setback…smh
I also received a check late Dec 2015. The second was to be in September 2016 depending on the number of those who cashed their checks . I tried to look up more info on this ..but haven’t been able to . I tried calling the claims administration on top of page and nothing .phone is always busy. Is there a way to keep up with this ..it how ? They claim not to do nothing . Geez. .this is as bad as walmart ..and that is who messed up on my background check .

Wal-Mart is the one who brought it to my attention all the others U I applied and was denied never stated why..Lastly it cost me my job at dillards and embarrassed me so badly I was terminat Ied for falsifying my application..Then i got my attorney on the case And was given my job back within 24hours..But nothing excuses the emabaressmet I suffered that day and it never was the same holding work environment after that..Simply a opportunity for Management out the window..
After calling the Attorney under the case name office I learned that there will Not be anymore checks being mailed out she stated this case is completely over!! YET I WAS TOLD IN SEPTEMBER MORE CHECKS WILL BE ISSUED IF EVERYONE DOES NOT CASH THEIR CHECK!!!SCAM AT ITS FINEST!!!!
who knows.. it may take a few weeks or months depending how fast they are in mailing..the company got sued for a huge chunk! really u think they are willing to spread the love ??? my blemish on my background check happened 20 plus years ago..i reckon we all have to wait and see if the SECOND PAYOUT will fall in our laps . we maybe collecting our security by then ! LOL

I finally got a call back and they left me a voice mail saying second checks will go out end of September/ 1st of October but I haven’t received anything yet.
I filed a dispute case#33766445 false info provided to dollar general. Monster,indeed,career builder they provided false info also
First check for $916.95 12-30-2015 & I paid taxes on that because it’s not pre-taxed. Second settlement in September is an undisclosed amount from what’s left over

I have not an I have been unAble to contact them directly anyond have a gud number …It stated if no one else cashed their check another would be dispensed by September 4th…They owe me for eight years and student loans for not being allowed to work for WAl-Mart Pharmacy. after I had the job start date and all….Entire Career went no where due to those reports…

I was pasted over for jobs from usps because of bad info by gis this year and last after disputing their info got a letter with a new backround check with not a thing on my record but this stoped me from getting jobs what can I do to stop this ?
I was actually working and on the job when this came up. My paycheck did get HELD-UP due to this error on their part. The other person: First name common and found all around Chicago where I have never been.
