General Information Services Inc. (GIS) has reached a class action lawsuit settlement over allegations it violated the Fair Credit Reporting Act when providing information for consumer background check reports. If you were the subject of a criminal background check report that contained information furnished by GIS, you may be eligible to claim approximately $40 or $1,500 from the class action settlement.

The GIS class action settlement resolves allegations that the background screening company provided reports that contained expunged criminal records (the “1681e Settlement Class”) or did not mail notices to consumers that GIS had reported public record information likely to have an adverse effect upon the consumer’s employment on the same day that GIS furnished the report to the end-user (the “1681k Settlement Class”).

The GIS background screening class action lawsuit claims that GIS violated the FCRA by allegedly, “a). Failing to notify consumer contemporaneously of the fact that adverse criminal record information is being provided to employers or prospective employers; and b.) Failing to maintain strict procedures to insure that the adverse information being reported is complete and up to date.”

GIS has denied liability, but according the background screening class action lawsuit, “nevertheless desires to settle the Plaintiff’s and Settlement Class Member’s claims solely for the purposes of avoiding the burden, expense, risk, and uncertainty of continuing the Litigation[.]”

The GIS class action settlement potentially affects anyone who applied for employment within the last two years and were knowingly or unknowingly subjected to a GIS consumer report.

Who’s Eligible

You are a Class Member of the GIS background check class action settlement if:

1) You applied for a job position where GIS provided your prospective employer with a background report containing an expunged criminal record between Dec. 22, 2009 and March 1, 2014, or if

2) You applied for a job where GIS provided a potential employer with a background check that contained information from public records, but you were not informed by GIS through a mailed notice on the same day, or not informed at all,  that GIS provided an employer with the report between Dec. 22, 2009 and March 1, 2014.

Potential Award

$40 or $1,500

Proof of Purchase

N/A. Unless they voluntarily exclude themselves, eligible Class Members will automatically receive a GIS settlement check in the mail.

Claim Form Deadline

N/A Class Members will automatically receive benefits if the GIS class action settlement is approved, unless they exclude themselves by Sept. 4, 2014

    I received my check for $906 and was told I might get another check if all eligible persons don’t cash their checks. No complaints here. My back ground check was cleared because of their mistake but I had no problems getting a job. Thanks for those who fought the system and won.

      I too received the same thing but ut cost me a job in the pharmacy which I went to college for with loans taken out…I was with the job then refused the job of incriminating reports from Gis. I had to orive their informatiin was inaccurate took 5years to get this reply from them The $908 was an insult considering the amount of money I could have grossed working for them with the Benefits smh. 5 years later..

    I too have suffered a passed over job opportunity with USPS. Apparently, GIS performed a background check on me and found a hit with a person in VA. with my name and DOB. Grand Larceny was the conviction. Problem is we have different social security numbers and are of different ethnicity. If GIS had done what they were hired to do instead of a google search, I would be employed. It took me less than five minutes to look at the court document and find that this individual had nothing in common with me other than name and DOB. Sure, you can file a dispute but it takes 10 – 14 days to get a response (5 minutes online). That is mailed to you. No job for me 6 months for the other thief. USN Retired

    My USPS candidate ID is: 82237729. I have received a call from GIS today (1/16/2015) when I questioned the accuracy of their background report. GIS reported that my Driver’s license was expired; however, upon a quick review of my driving records located at GIS, she discovered I had applied for my WI. drivers license three days before the Texas drivers license expiration. She immediately told me she would file a dispute in my behalf to correct the error. I was wondering why it is taking over six months to find employment.

    I received a check for 49.50 but what I’d like to know is who all did they run backgrounds for like which company’s it doesn’t say…..

    I would be a victim of this class action lawsuit for GIS a well as my husband too. Also there is another big lawsuit someone should check into with Dollar general in district 277 region 42

      I received one check because of dollar general his background check. I had to dispute it. But do you guys know that GIS did some of the monster, career builder, indeed back ground checks. I was getting letters of denial for employment for years because of them…second payout September 2016

          The letter stated the second check will be sent in September. I got a call saying the end of September or the first of October. I haven’t received any thing as of yet but I am in the middle of changing my address so it may be floating around the post office.

    My post card from the settlement said I would receive $38. I won another amount from the Hire Right class action lawsuit of $4400. Why is this one so low. Is there anything I can do to get the higher amount? After all I was screwed big time by this incorrect reporting, missed out on an amazing job.

      A higher amount? Greedy swine. Move on and get a job instead of trying to leach money. If they send you $38 then you get $38 and be grateful you were included.
