Nationwide consumers who own a PCS I or PCS II long-term care insurance policy through Genworth Life Insurance Co. or Genworth Life Insurance Co. of New York may be eligible to receive certain disclosures, new policy options, and potential payments or credits thanks to a recent Genworth class action settlement.
Settlement Class Members include all policyholders who own a PCS I or PCS II long-term care insurance policy or state variations of those same policies anywhere throughout the United States.
According to the class action lawsuit, the company withheld material information from policyholders regarding future rate increase plans, which would have been necessary to implement in order to pay future claims. This lack of information, the plaintiffs allege, amounted to fraudulent inducement by omission.
The company, which offers long-term care, mortgage, and other insurance products, denies all allegations and claims of wrongdoing and does not accept legal liability for any of the allegations.
The Court did not make a ruling in this case, so no determination of guilt has been made. Both the plaintiffs and the company opted to agree to the terms of the proposed settlement agreement rather than continue pursuing the case in court.
As part of the class action settlement, Class Members will receive a special election letter, which will contain information about Genworth Life’s future rate increase plans and the reason these increases are needed. At that point, they’ll have the right to elect to either keep their existing rate or choose from a selection of reduced paid-up benefit options or reduced benefit options.
Eligible Class Members have three options.
Class Members who do not take action will be bound by the terms of the settlement agreement, which means they’ll lose the right to pursue future lawsuits regarding this matter. These Class Members will receive a letter regarding the settlement benefits.
The second option Class Members have is to exclude themselves from the current settlement. Class Members who opt to exclude themselves will retain the right to seek out future litigation against the Company regarding this matter. They will not, however, be eligible to receive benefits of the Settlement Agreement.
To exclude themselves, Class Members must notify the Genworth long-term care class action settlement administrator by Dec. 28, 2021.
Finally, Class Members have the right to object to the settlement by Dec. 28, 2021.
A final hearing in the Genworth Life long-term care settlement is scheduled to take place Feb. 9, 2022.
No claim form is required.

When my ex-wife and I purchased our policy in 2000 our agent assured us there would be no rate increases. Of course that is considered hearsay. At this point I am leaning toward taking the 5th Option just to have something. That said, I have doubts about this company’s interest in paying out any claim.

A friend of mine has had Genworth LTC insurance for over 25 years and has paid every premium increase!!!! She is now in a nursing home because she cannot live alone and Genworth is NOT paying for her care. WTH!!!!! I also have had GLTC for the same amount of time, but luckily I am doing ok health wise, but I am terrified that Genworth LTCI is not going to come through for me.
I currently have a Long Term Care policy with State Life Insurance. I filed a claim with the Insurance company. After providing years of medical records proving my disability, my claim was cancelled. I am located in Texas and is looking for advice on how to best proceed against the company I paid premiums to for years.
Genworth Long Term Care policy starting with JFG followed by numbers. The rate hike is about $3000 due in January. We have a repayment policy so we pay the provider up front and are SUPPOSED to get reimbursement. Getting any money repaid is difficult and very arbitrary rules seem to apply. The phone numbers are not answered, and policy holders cannot get through to speak with a human. We have logged in online and done what we can, but customer service is terrible! Should we be part of this settlement? I do not understand the three letter codes referred to in the statement of claim.
Please add me, I don’t understand why my premium jump so high I am struggling right now and I don’t know what to do so I’m asking you please to include me in this lawsuit and on top of that I don’t understand the pcs-1 or the PCS-2 have three letters and numbers and don’t even understand how this thing is supposed to go but I personally am very depressed about how this company genworth exploded with extravagant prices please include me in this thank you very much.

Is Genworth Financial Long Term Care still paying claims for members health care? Essential I know Immediately.
I wrote to you once before on November3-2021. but I did not hear back. We took out our policy # 7030 with General Electric on June 14,2000. Then it was taken over by Genworth policy
# UCG4042546 Due to high premiums we chose “Limited Benefit option election”
We would like to be included in this settlement. I would appreciate an acknowledgment that we are included in the law suit. 865-216-0132
