Gallup TCPA class action settlement

A settlement has been reached in a class action lawsuit alleging Gallup Inc., formerly known as the Gallup Organization Inc., violated the Telephone Consumer Protection Act (TCPA) by using an automated telephone dialing system to place calls to cell phones without the prior express consent of the recipient of the call. If you received a survey call to your cellular telephone from Gallup, you may be eligible to receive a payment from the TCPA class action settlement.

This Gallup TCPA settlement will resolve three class action lawsuits that were consolidated into one case, titled Soto v. The Gallup Organization Inc. The TCPA protects consumers from unwanted phone calls and text messages. Gallup denies any wrongdoing but agreed to settle the TCPA class action lawsuit to avoid the risk and cost of trial.

If approved, the Gallup class action settlement would provide $12 million to pay claims from Class Members, plaintiffs’ attorneys’ fees and costs, incentive awards and costs of settlement administration.

Class Members of the Gallup TCPA settlement should have received a postcard notice in the mail. If you did not receive notice of the class action settlement but you believe you are a Class Member, contact the Settlement Administrator.

UPDATE: On Feb. 1, 2016, our readers confirmed that Class Members who submitted timely and valid claims for the Gallup TCPA settlement began receiving checks worth as much as $32.18.

Who’s Eligible

Under the terms of the Gallup class action settlement, Class Members include: “All persons in the United States who received a survey call from Gallup to a cellular telephone, through the alleged use of an automatic telephone dialing system, from August 16, 2009 through August 16, 2013.”

Potential Award

It is estimated that cash payments will be between $25 and $80 per claim. The actual amount depends on the total number of timely and valid claims submitted by Class Members.

Note: Class Members may make only one claim per cellular telephone number for any calls they received from Gallup during the relevant time period.

Proof of Purchase

N/A. Class Members must provide the cell phone number at which they received calls from Gallup without their prior express consent.

    I received a postcard with ID#GA94739699. The last 4 phone: 2525. I do not have a landline or cell phone that ends with those 4 digits, so I could not get far enough into the claim form to contact you. This is my question to you to please verify the phone number ending with 2525. If that is valid, the owner of that phone number should be notified. Thank you.

    I receive these gallup on my house phone, which is a cap-tel for hearing impaired people. They never leave a message.But the name come up gallup. We are on the DO NOT CALL LIST.

    My cellular account with AT&T has four numbers, only one of the numbers received a postcard.

    Ms Doryce Your right their giving the last 4 digits of a number its probably not a number you ever had. My son and i got a post card each with different ID nubers. The cards had the same last four cell numbers. I think one way you can get your old cell numbers during that time frame. You can inquire with your cell phone currier or past curriers about any of your old cell numbers. hopefully this information is a bit helpful remember you need to do a seperate form for each cell number.

    I contacted the FCC concerning the shady business dealings at Tunecore. They are suppose to push artist songs and collect royalties. They are not playing fair. In the past two years TuneCore states I earned $2.00 on my 50 song repertoire. They seem to only push Idol and Voice artist. Nimbit also steals. I believe artist are being stolen from and complaints are trickling in. TuneCore told me that my complaining would result in dire consequences (they left this on my telephone answering machine). Three employees at TuneCore told me three different things about my earnings and where they went. I don’t think they are suppose to threaten someone for asking a question.

    I have had so many cell phones and numbers since 2006 that I have no clue which number they are requesting ! The notice gave the last 4 digits of one but I don’t remember the other 3! I don’t even remember any of my numbers, I did find a partial list but it does not have any with the last 4 that was listed on the list. The online claim form says if you cant remember your number to use the paper form but it too gives you any explanation of what to do in case you don’t remember! Am I missing something here? What do I do????? Please help

      I have had a few cell phones and numbers. I do not recall what the PRE-FIX is/was at that time. I researched what records I have in my home to no avail. What do I do? Help.

        Print off the form (If you still can)…and send it in. The printable form doesnt require you to confirm the prefix. We had the same issues.

    There is still a deadline that has to be met before any claims are paid which as you see above isnt until the end of the year. Also, they will match any numbers you gave them to the records they have of placed calls. If any of your numbers do match then you will be paid your share of the settlement. This can take anywhere from 9 to 12 months to finalize.

      Not true. We couldnt recall the phone number to confirm it was ours (the proof they require on the online form). We havent had this phone number in years and couldnt remember it. I called the lawyers office and they said that if we printed off the form and sent it in, we didnt need the phone number confirmation thing to enter into it. Thats how we got around that. I mean really, how in the world do they expect everyone to remember a number from 2-4 years ago if youve gone through a few since then. So, Im sure theyll use that for some confirmaiton but its not dependent on you having that phone number confirmed.

    I have not yet received any settlement amount, I did file a claim in this action with a lot of numbers I gave the list of numbers on my claim.
