A $4 million settlement has been reached to resolve claims that Flagship Credit Acceptance LLC called consumers using an autodialing system in violation of federal law.

Although the exact payout will depend on how many claims are filed by Class Members, the $4 million settlement stands to result in significant compensation for consumers who received unwanted calls from Flagship.

Class Members in the Flagship settlement include all individuals who were called by Flagship through any version of a TCN, LiveVox, or Aspect dialing system and/or with an artificial or prerecorded voice between May 5, 2013 and Sept. 18, 2018.

According to the Flagship Credit class action lawsuit, the auto loan company “bombarded” plaintiff Robert Ward with unwanted prerecorded messages even though he is not a Flagship customer.

Ward claims that he repeatedly waited on the line to speak with a live agent to inform them that they were calling the wrong number.

The Flagship auto loan financing class action states that Ward was often assured by Flagship agents that the robocalls would stop, but the calls continued over his objection.

Ward states that because Flagship did not have his permission to call his cell phone and the prerecorded messages were not made for “emergency purposes,” the auto financing company violated the Telephone Consumer Protection Act.

The Telephone Consumer Protection Act (TCPA) is a federal law which protects consumers from harmful telemarketing practices including:

  • Placing robocalls through an autodialing machine or prerecorded message;
  • Sending unsolicited text messages;
  • Not providing consumers with an opt out option during telemarketing calls;
  • Calling numbers on the Do Not Call Registry;
  • Sending unsolicited “junk faxes” (advertisements sent without permission);
  • And more.

Under the TCPA, consumers may be eligible to collect between $500 and $1,500 per violation by taking offending businesses to court. Because these penalties can add up quickly, businesses may choose to settle lawsuits against them for a sum smaller than a class action verdict.

By settling the allegations against them, Flagship does not admit any wrongdoing. In fact, the company “vigorously denies” the claims against them and instead settles the class action for $4 million to avoid the costs of future litigation and the uncertainty of a trial verdict.

Class Members who want to object to the settlement or wish to be excluded from its terms have until Feb. 25, 2019 to do so.

UPDATE: On Feb. 13, 2020, a federal judge denied final approval of a Flagship TCPA class action settlement, finding the deal unfair to Class Members.

Who’s Eligible

All individuals who were called by Flagship through any version of a TCN, LiveVox, or Aspect dialing system and/or with an artificial or prerecorded voice between May 5, 2013 and Sept. 18, 2018.

Potential Award

Will be determined by the total number of valid claims filed by Class Members.

    They called me all the time. Even call other people whose phones I used to make payments

    I called them many times to ask them to stop with all the calls, I was getting so many I would have to turn my phone off at work to just get some peace. I was told that they had no control over how many times the call goes out which I find absolutely unacceptable

    The judge sent this back to trial partly because the original lawyers were trying to take millions out of the settlement leaving us each with $40!! From what I can find online and translate the lawyer/court talk it is being reevaluated…they may get more out of Flagship from what I can gather. They appointed a new Pennsylvania judge July 15, 2019 and there was another document from Aug 9, 2019 but I am not allowed to view the last one. (Some info is public and some is not since the case is still going on.)

    Keep your fingers crossed! The law states that each robocall is $500-$1500…

      Wow good to know thank you for that information Rudy. I sure hope that they send us more than $40.00 that’s ridiculous. Thank God we were able to pay off our loan with these people and hope to never have to deal with them again.

      Well that would be an astronomical amount for those of us still receiving them. I wonder what the cap is. I mean all of us have received more than one call so I wonder how they determine that. You would think Flagship would go bankrupt paying for all of those calls. And what they settled for doesn’t even cover the $500-$1500 for even one call per customer with how many opted into the lawsuit!

    I believe this was a scam I filled out the form and never heard anything back and I did it in a timely manner what is the problem with getting paid they sent me the form themselves to my house I’ve been waiting patiently.
