First National Bank Overdraft Class Action Settlement

A federal judge has approved a $3 million class action settlement between First National Bank and customers who say they were charged improper overdraft fees. Class Members will automatically receive an account credit or check if they incurred one of these fees.

Who’s Eligible

Class Members of the FNB overdraft settlement include all customers who had a First National Bank of Pennsylvania checking or demand deposit account that they could access with a debit card and who incurred an improper overdraft fee between June 1, 2006, through and including February 8, 2013.

Potential Award

Varies. The amount of money you will receive from the FNB overdraft class action settlement will be based on how many Class Members there are and how much money they paid in improper overdraft fees.

Claim Form Deadline

There is no claims filing process; current account holders will automatically receive their portion of the class action settlement deposited to their accounts. Former account holders will receive a payment via mailed check.

Case Summary

The FNB overdraft settlement resolves a 2012 class action lawsuit (Ord v. FNB Corp.) that alleges the bank reordered debit and credit card transactions from highest to lowest dollar amount to increase the likelihood that customers would overdraw their accounts and trigger overdraft fees. This practice violated its customer contract, violated state unfair trade practices laws, and resulted in unjust enrichment, according to the class action lawsuit.

FNB denies any wrongdoing but agreed to refund customers through a class action lawsuit settlement fund to resolve the litigation.

    They are definitely up to something fishy. They hold funds for too long, even government paychecks, then charge multiple overdraft fees when things should have been covered, even by an instant venmo. I told them their actions were likely illegal, other banks had gotten in trouble for such things.. the bank manager was not pleased.

    I have had an account with first national since 2007. I have had countless overdraft fees. That makes no sense on my end. They literally set you up to fail. Yesterday my account was positive $815. I received my $300 deposit back from Enterprise which was why I had so much in my account anyway. I withdrew $500 for my rent and spent $20 additional dollars. All of my bills and transactions from the weekend had cleared. At 4am I received an alert that my account was below $20. Which should not have been true. My account is overdrawn by $138.84. With the 148$ overdraft fees now showing at 6am. My account is now negative $311.84. Which makes no sense because the transactions that caused the overdraft were from 10/08/21 which had cleared on monday the 11th. My account is set up to not allow my debit card to overdraw my account so how can it be overdrawn to begin with. These overdrafts keep coming all the time and have seem to have gotten worse over the past couple of years. Their excuse is always that the transactions clear differently on their end then what i see on my account. That literally makes no sense so as per always the rich get richer off of the poor. I am done with this bank. I can’t continue to give my money to a corporate bank while I work my ass off for my money. How can they continue to do this when they had a 3 million dollar class action lawsuit in 2013. Where is all my from this lawsuit???? I will not stop until I am heard!!!!!!!!!!!!!!!!!!!!!!!

      I believe you. I worked in banking for years. They try to explain why deposits don’t hit your account. I contacted upper management. FSNB retaliated by abruptly taking me out of the overdraft protection plan and asked me if I wanted to be re-instated? I said of course not. I am glad to read yall comments. There are lot of vulnerable people out here.

    i banked with them when this happened my problem is this federal court found them guilty and made them refund customers wasnt much. FNB denies it did anything wrong, thats like a murder getting sentenced, sitting in prison claiming they are not guilty. nobody held accountable.
    1st they needed this lawsuit because of the transaction swap arounds to over draft your account, it was super in your face we are screwing you for profit.
    2nd I think people working for the bank operated outside of the best interest of the bank but the bank has multiple other reasons not to bank with them. Or the bank taught them this trick because it did just start happening when it did.
    3rd where did the people that started this practice go because now we have guilty banks shut down. did they just get a job somewhere else i currently have had atlantic broadband double billing and charging late fees for future service when calling them out on it they claim they provide this great service to the entire east coast, common trend they blame it on their computer. trash company i had not used for over a year billing me because they could not stop it on their end once every three months the bill goes out you think you paid but not sure so you pay again and oh we stop it only to get another bill in three months.
    Township sewer department 3 times your water bill. this one for the longest time only took cash gave a small receipt new you probably threw it away.
    what iam saying is check your bills if you live near a FNB bank odds are these people learned how to manipulate bills fees and have moved on to other companies not to mention these are mostly in democratic areas.
    this lawsuit should of went after the people responsible and publicly announced everyone to warn other businesses of the people responsible. you go after the corporation and the slap them with a fee FNB probably fired them internally now they spread this get rich tax under another company name destroying their reputation.

    I have the same problem with my local FNB bank and they do not intend to stop taking my money. I sat down in their office for over an hour and talked to the manager about it and all she agreed to do was a one-time only $37 refund. The theft adds up to a thousand.

      They have done this to me also in the thousands… the lawsuit hasnt stopped them. I wish there was another class action suit against them, horrible con artist bank

        Yes they are still at it. I switched banks in 2019 but never closed the FNB account. a $12 mishap to this account has cost me $193.52 in fees to them in just 2 weeks. They definitely need another class action suit.

      I believe you. FSNB refunded me several $20 overdraft fees. Screen-shot that $37 refund fee as proof and go get your thousands.
