Details: Fifth Third Bank has agreed to a $9.5 million settlement of a class action lawsuit concerning the way it issued overdraft fees. If you paid overdraft fees related to a Fifth Third debit card, check card and/or bank card, you could receive up to three times the amount you were charged from the class action settlement.
According to the Fifth Third class action lawsuit, Fifth Third Bank posted debit card transactions and/or ATM withdrawals in non-chronological order so that the bank could maximize the number of overdraft fees it charged to customers who had insufficient funds. Fifth Third Bank denies any wrongdoing, but has agreed to establish a $9.5 million settlement fund to settle the case, entitled Schulte v. Fifth Third Bank.
If you had a Fifth Third bank account at any time between October 21, 2004 and July 1, 2010, and incurred at least one overdraft fee as a result of the “re-sequencing” of at least one Fifth Third debit card transaction in non-chronological order, you’re considered a member of the settlement class and eligible to receive a cash payment from the Fifth Third overdraft fee settlement.
As part of the Fifth Third overdraft class action settlement, class members who submit valid claim forms by the deadline of May 2, 2011 will be eligible to receive up to three times the amount of overdraft fees they claim they were charged, depending on the total amount of valid claims submitted. If you do not have all of your bank records to support your claim, and your claim is based only on your best knowledge and belief, Fifth Third has the right to contest your claim.

I didn’t even go back as far as 2004 but they ripped me off so many times resequincing it would have costed them out the wazoo, I have called 20 times trying to figure out the statis of this settlement but nothing? They owe me, I want answers when will we get ower money? They didn’t hesitate to take the money from the little people but they are damn sure taking there time giving it back…. HELLO just another way for the big man to shit on the little man I guess.. I have had enouh of it all its time for the big man to take a hit… let them see what its like to have a real buget,

I have the same problems as you- they tried to charge me for my records and I have heard nothing since filling out the claim online. On top of that, some company that won’t give its information is calling my dad- not me even though I am listed- about me and Fifth Third threatening to sue me. Which is odd since they did not start calling until I was contacted about the settlement- my account was closed in 2008.

I could not log onto the Fifth Third site to view my records either. When I went to the branch, they tried to charge me hundreds of dollars to see my history. Luckily, I had an old Microsoft Money file that I was able to convert and open. I was able to find a particularly bad period of time with over drafts, but I can’t say that it was the worst without all of the records….
It seems to me this should have been handled better. I would imagine that most be who’ve had overdraft problems probably aren’t the best record keepers or had something bad happening at that time in their life. So it seems most people affected probably won’t be filing a claim. The bank has the definitive records, so it would be easier for everyone if they just reviewed them.
Anyway, it would be nice if there was a way to check the status of a claim. Or at the very least, have some news updates on the site. I haven’t heard anything for a while now.

I too, was told that I had to pay $5.00 for every statement I ordered. I asked the rep if I went into the branch, would they charge me. She said yes. I had to guess because I don’t have the extra money to go back to 10/2004. They should have posted all the way back to 2004 or at least let me get the info from the branches. They only posted 16 months. Now I’m wondering if I will be penalized for not having the correct info.

I went into a branch to obtain statements for 3 months of 2008 and spoke to a manager. She obtained them for me free of charge.
I suggest walking into a branch, asking to speak to a manger, and explaining that these statements are in relation to the class action suit. I couldn’t access them online as my account was closed in 2008. Fortunately for me, I knew what months I had been charged overdraft fees (I was charged 387.00 worth of fees from Jan 08 to March 08… I couldn’t forget that…).
They should give them to you free of charge; it’s a stipulation of the terms of the litigation. if they don’t, make a fuss, keep going up the chain of command, or try different branches.

You should still be able to view those somehow. Our accounts have been closed over a year and I was still able to access them on their website.
We no longer have Fifth Third accounts but could still sign in and view previous statements.

I tried to view my accounts on line, but could not because I have new account numbers. A personal Banker closed my old accounts and open new ones. I would still have the same accounts if the Personel Banker had not changed them.
I called the bank today and was told I would have to pay $5.00 for each one, which should be available on line free! Is this a way to preventing me from viewing my information for free?
