Family Dollar has agreed to pay $1.5 million to settle a class action lawsuit that accused the discount retailer of violating the Telephone Consumer Protection Act by texting customers without prior express written consent.

Lead plaintiff Reginald Moore of Missouri filed the Family Dollar class action lawsuit after allegedly receiving numerous text spam messages on his cell phone regarding sale items.

Under the terms of the class action settlement, Class Members will receive a portion of the $1.5 million. The estimated settlement pay-out is valued at $45 in cash as well as a Family Dollar $30 gift card for each Class Member.

Individuals who want to object or opt-out of the Family Dollar settlement must do so by May 18, 2016.

Who’s Eligible

Family Dollar settlement Class Members include all U.S. residents who were sent text spam from the company as part of a subscription-based program between Oct. 16, 2013 and Mar. 7, 2016.

Potential Award

$75 – $500

Class Members are estimated to receive a cash pay-out of $45 as well as a Family Dollar gift card valued at $30. Depending on the number of valid Claim Forms, Class Members may receive up to $300 in cash as well as a Family Dollar gift card of $200.

Proof of Purchase

N/A

Class Members do not need to provide proof of purchase but they must submit a Claim Form no later than June 3, 2016 to receive benefits from this TCPA settlement.

    why have a claims in if you did not get a post card click here. “on the website” why would they waste the time of even getting the claims,,,, if you are going to get denied claims ? and the admin. foreseen that,, I see some thieving going on here . For a fact that exact number was on several of my phones .

    It is not above these Settlement Admins to ‘sticky finger’ out of Settlement funds. As a matter of fact, the Nightly Business Report just did a quickie story on how a Settlement Admin (A Law Firm) was busted for ‘re-allocating’/mis-managing funds out of a Settlement Account they were in charge of. We take for granted that because they are a ‘Law Firm’, that they wouldn’t do something so lowlife & corrupt as to steal out of these funds, but they do and many times we hear nothing about it.

    I think the UPS store where my mail goes..someone is stealing my mail. Every time I go inside the store the manager is looking at me creepy. I think something is wrong. I was to receive mail from Vegas 2,weeks ago. Low and behold I haven’t received the package as of yet. And then every once and awhile a settlement check would appear.
