Equifax data breach class action lawsuit settlement updates:

  •  This class action settlement is paying out up to $22.82 as of Dec. 22, 2022.
  • Congratulations to everyone who filed a claim and got paid!

  • Class members are receiving emails alerting them of their eligibility for a payment from this settlement.
  • The settlement administrator is offering the option to receive the payment either via PayPal or pre-paid card. Those who would like to change their payment method to one of these should visit the administrator’s payment selection form page.
  • Those who wish to receive a physical check do not need to take any action.

  • On Nov. 2, 2021, the U.S. Supreme Court denied a petition to review the appeal.
  • At this time, it is not known how quickly payments will be made to claimants.

  • On June 3, 2021, the 11th Circuit Court of Appeals upheld the $425 million Equifax data breach settlement.
  • It is not known at this time how quickly claims will be paid.

Equifax has agreed to pay at least $380.5 million to resolve class action claims associated with its massive 2017 data breach.

The Equifax class action lawsuit settlement will benefit any of the estimated 147 million people affected by the September 2017 Equifax data breach.

In 2017, the largest data breach of personal and financial information in American history occurred, involving almost half of the country’s population. In November 2017, plaintiffs filed an Equifax lawsuit claiming the credit bureau failed to protect consumer information.

Consumers affected by the Equifax data breach may wish to better protect their online privacy with products from Norton LifeLock.

Equifax reached a settlement with the plaintiffs to resolve claims that their poor cybersecurity resulted in the breach of millions of consumers’ private information. The credit bureau does not admit any wrongdoing by settling the case against them.

Equifax data breach class action settlement benefits

Under the terms of the Equifax class action lawsuit settlement, the company will pay at least $380.5 million into a restitution fund and an additional $125 million to cover out-of-pocket costs if the restitution fund is used up. The credit bureau will also make changes to their business practices to help keep consumer information secure.

There are several benefits available under the Equifax class action lawsuit settlement. Consumers can choose between free credit monitoring services or a $125 cash payment. Additionally, the settlement provides up to $20,000 in expense reimbursement and at least seven years of free identity restoration services.

Claims for credit monitoring services, alternative reimbursement compensation, and Equifax subscription product reimbursement are all due by Jan. 22, 2020.

Claims for current out-of-pocket losses and/or time spent are due by Jan. 22, 2020 but Class Members can file claims for future losses and time until Jan. 22, 2024.

The deadline for exclusion and objection is Nov. 19, 2019. The final approval hearing is scheduled for Dec. 19, 2019.

Who’s Eligible

Any of the estimated 147 million people affected by the September 2017 Equifax data breach.

Potential Award
  1. Free credit monitoring or a $125 cash payment. Three bureau credit monitoring through Experian would be offered for at least four years and one bureau credit monitoring would be offered for an additional six years. Cash payments are available for Class Members who have credit monitoring services that will continue for at least six months.
  2. Up to $20,000 in reimbursement for expenses, including time spent remedying fraud (up to 20 hours at $25 per hour), out-of-pocket expenses, and the cost of credit monitoring (up to 25 percent of these costs).
  3. Free identity restoration services for at least seven years.

UPDATE: On July 31, 2019, The Federal Trade Commission reported that due to overwhelming public response, claimants that select to receive the cash payout from the Equifax Data Breach Class Action Settlement, will be receiving significantly less than the estimated $125. While the total settlement amount is over $300 million, only $31 million was set aside for claimants that select the cash payment over free credit monitoring.  Top Class Actions will continue to provide updates as we learn more.  

UPDATE 2: On Nov. 19, 2019, the class action watchdog Center for Class Action Fairness filed an objection to the Equifax data breach class action settlement, claiming that the attorney fee request should be reduced and that the settling parties suppressed the claims process.

UPDATE 3: On Jan. 13, 2020, a federal judge gave a $425 million Equifax class action settlement final approval despite objections from consumer advocacy groups.

      I am still waiting to receive anything from them. I have contacted the settlement administrators number countless times and have been told they are still processing my claim. How long is a person supposed to wait for then to process a claim it’s been since the settlement was opened????

    I think it’s a load of crap that we even need to account for any fraud considering it can happen at any time for the rest of our lives because these people didn’t keep our information safe! I mean, a data breach should automatically quality you for payout from your information being non retrievable!

    the lawyers will chew up any settlement. I am still trying to get payment from past transgressions from data breaches and all that i was offered was security monitoring and so on. My credit was shot and the administrators of these similar lawsuits get paid and so do the attorneys but i never received any funds or money for what the data breaches cost me.

      I honestly couldn’t care less about a monitory settlement I just want the identity theft accounts that were fraudulently created using my information to be taken off my credit report because they are the reason it all happened and some may say well this couldn’t have happened they could not have used the information that was breached to set up a credit card account in your name, you probably did it and just want it cleared.
      But that’s not the case they took out half a dozen accounts in my name over $10k in revolving debt that isn’t mine and they want even look at a dispute form.
      FICO the credit bureaus it’s all a scam always has been.
      I hope they have to go into insolvency and get rid of credit scores forever.

    After searching for over a half-hour I could not find out if the above matter was relatively new, or still another data breach from Equifax.
    I had received a small settlement from a case in 12/2022, as well as, I think, their 100% fake, completely useless “credit monitoring”.
