DoubleDown Interactive agreed to a $415 million class action lawsuit settlement to resolve claims its casino mobile games violated Washington’s gambling laws.

The settlement benefits consumers who played DoubleDown Casino, DoubleDown Fort Knox, DoubleDown Classic and/or Ellen’s Road to Riches before Nov. 14, 2022.

DoubleDown Interactive is a mobile gaming developer that specializes in casino games. These games allow consumers who play casino games on their mobile devices.

According to a class action lawsuit, DoubleDown’s games violate Washington’s laws against gambling. In order to play DoubleDown Interactive casino games, users are allegedly required to use in-game “chips.” Although consumers receive a bundle of free chips upon downloading the games, consumers are allegedly forced to purchase additional chips using real money.

“Defendants’ online casino games have thrived and thousands of consumers have spent millions of dollars unwittingly playing Defendants’ unlawful games of chance,” the gambling class action lawsuit contends.

Since the game chips are purchased with real money and are used to wager for more chips, the plaintiffs contend the casino mobile apps represent illegal gambling schemes. These apps allegedly violate Washington’s gambling laws and, therefore, plaintiffs say that they are entitled to recover the illegal profits gained by DoubleDown Interactive.

DoubleDown hasn’t admitted any wrongdoing but agreed to a $415 million class action lawsuit settlement to resolve these claims.

Under the terms of the settlement, class members can receive a cash payment based on the amount they spent on in-game purchases for DoubleDown casino games, the number of claims filed and the net settlement fund after deductions. 

Class members who spent higher amounts on in-app purchases will receive larger payments. Coming soon, consumers can check the settlement website for a settlement payment estimate

Any funds remaining in the settlement after the initial round of checks and electronic payments may be used for a second distribution or donated to the Legal Foundation of Washington.

Also as part of the class action lawsuit settlement, DoubleDown Interactive has agreed to make changes to its casino applications to include information about video game behavior disorders. The games will also include a voluntary self-exclusion policy. 

The game developer has also agreed to gameplay changes that allow consumers to continue playing the apps without having to purchase additional in-game currency.

The deadline for exclusion and objection is Feb. 14, 2023. 

The final approval hearing for the settlement is scheduled for June 1, 2023.

In order to receive settlement benefits, class members must submit a valid claim form by April 11, 2023.

    What do they mean “the amount you paid to play games, is not your settlement” it specifies the amount I spent, so is it less or more?

      You will get a percentage of what you spent. You can red the Plan of Allocation on the settlement website to get an idea of what it might be.

    Ruth, I saw that also but I haven’t received anything. I had planned to contact JND today to see if there is any updated information.

      Happy, I spoke with someone at JND this morning. She basically read a script telling me the basics that I already know. She was able to pull up my information and see that I had a claim but she said it hasn’t been processed yet. I guess they are sending emails as they get the claim verified. She didn’t tell me if there is a particular order that they are processing them. Perhaps in the order the claims were filed.

        Ruth, I called yesterday also and got the same response. However, I woke up to my email notification from them this morning. Hopefully you have yours also or will soon. From what I’m seeing from other’s comments their notifications also state August 14th as the deadline to challenge. I’m assuming since they seem to be using that as a set day and the settlement agreement stipulates a 21 day period for challenges that notifications should be done by 7/23. Just my thoughts…

          Yes, I got the email this morning. My lifetime spending is about what I expected so no need to challenge. So now we just wait for the payments. A rep from Edelson told me it will probably be in October.

      I got mine yesterday the 22nd. I’m eligible and the spending amount seems correct so I don’t have to challenge. The estimate amount seems seems to be so wide ranged. $1300 to $3000. Hope it’s the higher end.

    Rpbert and Theresa: I spoke with a rep at Edelson a few weeks ago and she said they expect to send payments in October. I believe the appeals deadline was July 3, and they have 90 days after that to distribute the payments, which would be around the first of October. You should get a determination email (maybe within the next few weeks?) letting you know if your claim is valid and including your lifetime spending amount; you will have something like 21 days to dispute the number. Hopefully everything will go smoothly and there won’t be any delays like the Big Fish Settlement I have read about.

    You do not have to live in WA. Its online so it crosses state lines and eligible to anyone who played before Nov 2022.

        Deborah I find that interesting. I was able to see everything a couple of months ago when I filed my claim. Now I can only see the current month. I’m trying to contact them but it’s not easy to do.

          I did message the attorneys when I first noticed this they told me not to worry about it everything was coming in from I believe Google pay. But I still worry I did try to contact metapay is that what they’re called and got no response

            I believe everything gets traced back to your ISP. Because I had about five or six different accounts I would use. So I am hopeful that everything was sent out to the settlement administrator prior to things disappearing. If you go to the settlement site I believe it’s on there that everything was sent on a CD?

      Supporting documentation is not required. Per the Settlement Agreement, Lifetime Spending Amount means the total amount of money a Settlement Class Member spent within the Applications through and including November 14, 2022, which was provided to the Settlement Administrator by the Platform Providers.

      If you do not have all your Player IDs for the apps you have played, please ensure you provided all of the email addresses that may be associated with your accounts.
