DoubleDown Interactive agreed to a $415 million class action lawsuit settlement to resolve claims its casino mobile games violated Washington’s gambling laws.
The settlement benefits consumers who played DoubleDown Casino, DoubleDown Fort Knox, DoubleDown Classic and/or Ellen’s Road to Riches before Nov. 14, 2022.
DoubleDown Interactive is a mobile gaming developer that specializes in casino games. These games allow consumers who play casino games on their mobile devices.
According to a class action lawsuit, DoubleDown’s games violate Washington’s laws against gambling. In order to play DoubleDown Interactive casino games, users are allegedly required to use in-game “chips.” Although consumers receive a bundle of free chips upon downloading the games, consumers are allegedly forced to purchase additional chips using real money.
“Defendants’ online casino games have thrived and thousands of consumers have spent millions of dollars unwittingly playing Defendants’ unlawful games of chance,” the gambling class action lawsuit contends.
Since the game chips are purchased with real money and are used to wager for more chips, the plaintiffs contend the casino mobile apps represent illegal gambling schemes. These apps allegedly violate Washington’s gambling laws and, therefore, plaintiffs say that they are entitled to recover the illegal profits gained by DoubleDown Interactive.
DoubleDown hasn’t admitted any wrongdoing but agreed to a $415 million class action lawsuit settlement to resolve these claims.
Under the terms of the settlement, class members can receive a cash payment based on the amount they spent on in-game purchases for DoubleDown casino games, the number of claims filed and the net settlement fund after deductions.
Class members who spent higher amounts on in-app purchases will receive larger payments. Coming soon, consumers can check the settlement website for a settlement payment estimate.
Any funds remaining in the settlement after the initial round of checks and electronic payments may be used for a second distribution or donated to the Legal Foundation of Washington.
Also as part of the class action lawsuit settlement, DoubleDown Interactive has agreed to make changes to its casino applications to include information about video game behavior disorders. The games will also include a voluntary self-exclusion policy.
The game developer has also agreed to gameplay changes that allow consumers to continue playing the apps without having to purchase additional in-game currency.
The deadline for exclusion and objection is Feb. 14, 2023.
The final approval hearing for the settlement is scheduled for June 1, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by April 11, 2023.

I live in California and played double-down. I don’t remember how much I spent because it was so long ago. However, I received an email notice and I filed a claim. I asked for PayPal for direct deposit. I just don’t know how to find out how much I spent, it was back in 2015. I played through Facebook.
From settlement admin:
You should receive a check or electronic payment from the Settlement Administrator within 90 days after the Settlement has been finally approved and/or after any appeals process is complete, which is at least 120 days after final approval. The Settlement received final approval on June 1, 2023.

Deborah, I spoke with someone at Edelson a few weeks ago and she told me they expect to start sending the money in October. I read the agreement and saw that it says 90 days but I guess they expect delays. Were you part of the Big Fish Settlement? I saw that it took about 5 months for people to get their money (but it looks like they are using a different settlement company for this one), and I read several comments about the taxable/non-taxable debate. Some said taxable, some said not taxable. I’m wondering if anyone in that settlement talked to the IRS about it. The comments I read were pretty mixed about that. I’m thinking I might get a pretty decent settlement and I just don’t want to get on the wrong side of the IRS and have to pay a bunch of penalties and interest!

Final approval was granted yesterday, June 1st. I was told they expect to send claim determination letters sometime this summer, and the payouts in October. I’ve been reading comments about the Big Fish Settlement and from what I can tell, it was at least 5 months after final approval before anyone received any money. I did notice that this case is using a different settlement company, so maybe they will be a little faster with this one. I’m wondering if the money will be taxable. From what I have read about settlements, it would appear it is taxable, but several people in the Big Fish Settlement said their tax attorney/preparer said that the money is a refund so it’s not considered taxable income.
No it is not taxable it is a refund. And the judge has ordered everything to be paid within 90 days of the settlement hearing.

I was told yesterday that I have something coming and I don’t live in Washington I live in Illinois
And I received a notice in the mail I don’t think you have to live in Washington to get the money !
Is crazy I started playing Doubledown casino and I list over $1500 all they will sue was eat my chips in 5 minutes I will package of &99.99 will not even last for 10 minutes , I am from Florida and if someone from Florida wants to file lawsuit action I will be so down to do it they still scamming people not learning from their previous lawsuits , I can provide all my receipts of all money I lost
You could live in any state and would have qualified m. They sent notifications via mail and email if you could become a member of the suit.
