Residents of Illinois, Colorado, and Ohio who filed pandemic-related unemployment claims and were notified by certain state agencies about a 2020 data security incident may be eligible for compensation for out-of-pocket losses, documented time, or attested time thanks to a recent $4.95 million class action lawsuit settlement with Deloitte Consulting.

Settlement Class Members include those who were notified by either the Ohio Department of Job and Family Services, the Illinois Department of Employment Security, or the Colorado Department of Labor and Employment that they had their personal information compromised during the Pandemic Unemployment Assistance (PUA) data security incident between May 18 and 21, 2020.

Plaintiffs allege the agencies hired Deloitte Consulting to help them create websites that would then be used to facilitate the distribution of PUA benefits. Between May 18 and 21, 2020, certain private and personal information of claimants was visible on the website. The state agencies became aware of the situation and worked with Deloitte to correct the issue. 

Despite that, about 237,000 individuals had their information exposed.

Deloitte Consulting, which offers legal, tax, and financial-advisory services, among others, denies all allegations made by the plaintiffs in this class action lawsuit. 

The Court did not make a judgment or determination in this lawsuit. Rather, both the plaintiffs and Deloitte Consulting carefully considered the risks, benefits, costs, and time associated with attempting to continue to pursue the class action lawsuit, and agreed the proposed settlement agreement is in everyone’s best interests.

Eligible Class Members who spent money out of pocket to purchase identity protection or credit monitoring services can receive up to $120 each. 

Class Members who spent time dealing with issues as a result of the incident can claim up to four hours at $20 per hour, for a total of $80. If that time is documented, Class Members can claim up to eight additional hours at $20 per hour, or $160 total.

In addition to the monetary relief, Deloitte Consulting took certain measures and security enhancements, including reviewing the role-to-function mappings in PUA applications to confirm users only have the needed authorizations and conducting data minimization reviews of PUA applications.

A final hearing in the Deloitte Consulting class action settlement is scheduled for Jan. 31, 2022.

Class Members have the right to exclude themselves from this settlement. By doing so, they will not be eligible to receive compensation, but they will have the option to pursue future lawsuit regarding the security incident. 

Class Members also have the right to object to the settlement. 

The deadline to file an exclusion or objection is Jan. 3, 2022.

The deadline to file a claim in this class action lawsuit settlement is Jan. 17, 2022.

Who’s Eligible

Settlement Class Members include residents of Illinois who were notified by either the Ohio Department of Job and Family Services, the Illinois Department of Employment Security, or the Colorado Department of Labor and Employment that they had their personal information compromised during the Pandemic Unemployment Assistance (PUA) data security incident between May 18 and 21, 2020.

    I submitted my claim on time and have heard nothing back. In the meantime people have tried to open credit accts, get loans, got a car in my granddaughters name, and Who knows what else. I spent countless hours on the phone trying to fix this crap. Upset in Columbus, Ohio.

      I have gone through the same stuff and my girlfriend got hers last week and I call no one can tell me anything about we’re my payment and we submitted at the same time they won’t even email me back what a joke

    Really 160.00? That sure won’t cover the money I have lost. No idea how or who has been taking my money little by little and now my info is available on the dark web and I’m broke. No one wants to actually help me, my guess is cuz I have no money to pay anyone to help me. I can’t even pay my rent this month so thanks to the pandemic and our awesome government, I will be buried by debt, homeless, broke.

    I have had nothing but crazy since this occurred. Will I be reimbursed the 647 that was unauthorized transactions by a ghost. I’ve spent over a 100 hrs in chasing my money as it goes from my bank to the ghost yet again. Furniture has been bought that I would have loved to have yet the ghost has it. Just now I recall call from “Amazon ” someone tryingto trying to buy a iPhone.
    I’m beyond devastated and broke and 200 is what they think should receive . Smh
