A $12 million class action settlement has been reached that would resolve a class action lawsuit involving CytoSport, Inc.
The lawsuit alleges that the Defendant made false and misleading statements about the protein content of its Ready-To-Drink products and allegedly misleading “Lean” and “L-Glutamine” claims on its Protein Powder products.
Defendant denies any wrongdoing and denies the Plaintiffs’ allegations. You can read Defendant’s answer at www.LeanProteinSettlement.com. The Court has not made any ruling on Defendant’s liability, if any.
The settlement involves two classes:
The Shake Class includes all United States consumers who purchased Defendant’s Cytosport Whey Isolate Protein Drink; Monster Milk: Protein Power Shake; Genuine Muscle Milk: Protein Nutrition Shake; and Muscle Milk Pro Series 40: Mega Protein Shake between Jan. 23, 2011 (Jan. 23, 2009 in Michigan) and May 5, 2020. Class Members will receive $1 per purchased Class Product, subject to pro rata adjustment. Class Members without proof of purchase will be subject to a maximum claim of $25, but Shake Settlement Class Members with proof of purchase will have no cap.
The Powder Class includes all United States consumers who purchased any of the following powder products that had the phrase “lean lipids,” “lean protein,” “lean muscle protein,” or “new leaner formula” on the label: Muscle Milk: Lean Muscle Protein Powder; Muscle Milk Light: Lean Muscle Protein Powder; Muscle Milk Naturals: Nature’s Ultimate Lean Muscle Protein; Muscle Milk Gainer; High Protein Gainer Powder Drink Mix; Muscle Milk Pro Series 50: Lean Muscle Mega Protein Powder; and Monster Milk: Lean Muscle Protein Supplement between Jan. 23, 2011 and Dec. 31, 2018. Class Members will receive $3 for each purchase of a product weighing 2 ¾ lbs. or less and $5 for each purchase of a product weighing more than 2 ¾ lbs. Settlement Class Members without proof of purchase will be subject to a maximum claim of $25, but Powder Settlement Class Members with proof of purchase will have no cap.
Your recovery, and the recovery of every other claimant, will be proportionally adjusted to account for the available portion of the Settlement Fund. Depending on the total dollar amount of all valid claims, this adjustment may increase or decrease your recovery.
Class Members who want to submit claims or ask to be excluded from the class action settlement have until September 16, 2020 to do so.
Who’s Eligible
All U.S. consumers who bought CytoSport, Inc.’s covered shake products between Jan. 23, 2011 and May 5, 2020, Michigan consumers who bought CytoSport, Inc.’s covered shake products between Jan. 23, 2009 and May 5, 2020, and all U.S. consumers who bought CytoSport, Inc.’s covered powder products between Jan. 23, 2011 and Dec. 31, 2018.
Potential Award
Shake Class $1.00 per product.
Class Members are able to claim $1.00 per product, up to 25 products, without proof of purchase, which amounts to $25.00.
Consumers who provide actual purchase receipts to the satisfaction of the Class Administrator may receive $1.00 per product as settlement compensation for all products purchased, subject to pro rata adjustment.
Powder Class $3.00 per product of 2 ¾ lbs. or less and $5.00 per product weighing more than 2 ¾ lbs.
Class Members are able to claim $3.00 per product weighing 2 ¾ lbs. or less and $5.00 per product weighing more than 2 ¾ lbs., up to a claim amount of $25.00, without proof of purchase.
Consumers who provide actual purchase receipts to the satisfaction of the Class Administrator may receive the per product settlement compensation for all products purchased, subject to pro rata adjustment.
Claimant recovery, and the recovery of every other claimant, will be proportionally adjusted to account for the available portion of the Settlement Fund. Depending on the total dollar amount of all valid claims, this adjustment may increase or decrease recovery.
