Top Class Actions viewers say they are receiving settlement checks in the mail from CytoSport, Freedom Mortgage, AAG Telemarketing, and Lenovo class action lawsuits.

CytoSport and/or Muscle Milk Class Action Settlement

Viewers say that they’ve received their part of a $12 million settlement over CytoSport milk products in the form of checks worth up to $531.47.

CytoSport and Muscle Milk products were falsely advertised as “lean” or containing “L-glutamine,” according to a class action lawsuit lodged against CytoSport, Inc. The lawsuit concerned both powder and shake products sold by CytoSport between 2011 and 2020.

While the manufacturer refused to admit any wrongdoing, Cytosport agreed to pay $12 million to end the litigation. Consumers could make a claim in the settlement if they bought either shake or powdered products covered by the agreement.

Class Members who purchased shake products could claim $1 per product purchased, with a cap of $25 for consumers without proof of purchase. Class Members who bought powdered products could claim between $3 and $5 per product, depending on the size they purchased. Claims were capped at $25 for Class Members without proof of purchase.

The claim form deadline was Sept. 16, 2020.

The CytoSport Class Action Lawsuit is Clay, et al. v. CytoSport Inc., Case No. 3:15-cv-00165-L-DHB, in the U.S. District Court for the Southern District of California.

Freedom Mortgage TCPA Class Action Settlement

Settlement checks from Freedom Mortgage worth $75.40 have reportedly hit TCA viewers’ mailboxes recently.

Freedom Mortgage was accused of violating the Telephone Consumer Protection Act (TCPA) with unwanted telemarketing calls between 2013 and 2019. Consumers accused the company of targeting millions of current and former clients with calls using prerecorded messages and autodialers without first obtaining permission as required under the TCPA.

Freedom Mortgage maintained that it did nothing wrong, but agreed to pay $9.5 million to end the class action lawsuit. Approximately 1.5 million consumers were expected to be eligible for an estimated $37 class action rebate, under the terms of the settlement.

The deadline to submit a claim form was June 23, 2020.

The Freedom Mortgage TCPA Class Action Lawsuit is Somogyi, et al. v. Freedom Mortgage Corp., Case No. 1:17-cv-06546, in the U.S. District Court for the District of New Jersey.

AAG Telemarketing Class Action Settlement

Consumers have also reported seeing settlement checks from the AAG telemarketing class action lawsuit worth as much as $267.40.

Allegedly, American Advisors Group (AAG) peppered unwitting consumers with prerecorded advertising calls between 2017 and 2020. The company was hit with a class action lawsuit claiming violations of the TCPA for failing to obtain the permission of consumers before making the “frustrating, obnoxious, annoying” telemarketing calls.

AAG refused to admit any liability, but agreed to pay $3.5 million to end the class action lawsuit. Class Member awards were estimated to be between $20 and $40 depending on the number of claims filed.

Claim forms were due Aug. 4, 2020.

The AAG Telemarketing Class Action Lawsuit was Abramson v. American Advisors Group, et al., Case No. 2:19-cv-01341-MJH, in the U.S. District Court for the Western District of Pennsylvania.

Lenovo Laptop Adware Class Action Settlement

Class Members of the Lenovo settlement have reported receiving a second round of checks worth $3.47. These checks are in addition to settlement checks received in November worth as much as $244.52.

Lenovo was hit a series class action lawsuit alleging that the company deliberately included software in certain laptops that slowed down performance and monitored user activities for advertising purposes.

The plaintiffs accused Lenovo and software company Superfish of selling hundreds of thousands of laptops with such software.

Consumers complained that the program, VisualDiscovery software, not only caused their laptops to run inefficiently, but also invaded their privacy.

Lenovo paid $8.3 million to end the class action lawsuit, while also not admitting any wrongdoing.

Under the terms of the agreement, Class Members were expected to receive between $40 and $750. Settlement awards depended on the type of laptop purchased and if the Class Member could provide “proof of loss,” such as receipts for credit monitoring services or technical assistance.

The most recently reported settlement checks are likely leftover settlement funds that are being distributed to Class Members who received a larger check last month.

The deadline to submit a claim form was March 25, 2019.

The Lenovo Laptop Adware Class Action Lawsuit is In re: Lenovo Adware Litigation, Case No.: 4:15-CV-02624-HSG, in the U.S. District Court for the Northern District of California.
