Certified Forensic Loan Auditors LLC (CLFA) has agreed to settle a Consumer Financial Protection Bureau (CFPB) lawsuit that claimed it engaged in unfair and deceptive practices and charged illegal advance fees.

Individuals who paid for mortgage assistance relief from CFLA from July 1, 2014, through July 20, 2020, and have not yet received a check from CFLA or CFPB may be eligible for compensation.

According to Mortgage Audits Online, Certified Forensic Loan Auditors offered loan auditing and other legal services, working with homeowners, companies and law firms. The CFPB shut the company down and barred them from operation.

The Consumer Financial Protection Bureau is a government agency that “implements and enforces federal consumer financial law,” according to its website.

CFPB alleged CFLA and its owners charged illegal advance fees, a violation of the Consumer Financial Protection Act, to consumers seeking to re-negotiate, reduce or otherwise alter the terms of their mortgages.

Consumers who are eligible to receive a refund must submit a claim worksheet along with a list of all fees they paid to Certified Forensic Loan Auditors and proof of all their payments, such as credit card statements or canceled checks.

Those who receive a refund remain eligible to pursue other legal claims against entities named in the lawsuit.

The settlement website does not indicate any means for consumers to opt-out of or object to the settlement.

No final hearing date is indicated.

The deadline to submit a claim in the CFLA settlement is July 20, 2022.

Individuals who paid for mortgage assistance relief from Certified Forensic Loan Auditors LLC (CFLA) from July 1, 2014, through July 20, 2020, and have not yet received a check from CFLA or CFPB.
