Capital One class action lawsuit

If you received a non-emergency telephone call on your cell phone from Capital One Financial Corp. (or from another company on behalf of Capital One) through the use of an automatic telephone dialing system or an artificial or prerecorded voice in connection with an attempt to collect on a credit card debt, you may be eligible for benefits from a Capital One TCPA class action settlement.

The proposed settlement would resolve a class action lawsuit that alleges Capital One violated the Telephone Consumer Protection Act (TCPA) by using an automatic telephone dialing system and/or an artificial prerecorded voice to call cell phones without the prior express consent of the recipients.

The defendants deny the allegations but agreed to settle the TCPA class action lawsuit to avoid the risk and uncertainty of litigation. Under the terms of the class action settlement, Capital One, Leading Edge Recovery Solutions LLC, Capital Management Services LLP and AllianceOne Receivables Management Inc. will pay more than $75 million into a settlement fund for eligible Class Members.

Who’s Eligible

Class Members of the TCPA class action settlement include consumers who received (1) an automated call from Capital One between Jan. 18, 2008 and June 30, 2014 regarding a Capital One credit card account, or (2) an automated call from AllianceOne Receivables Management Inc., Capital Management Systems LP, and/or Leading Edge Recovery Solutions LLC between Feb. 28, 2009 and June 30, 2014 regarding a Capital One credit card account.

Potential Award

$20-$40, depending on how many claims are filed.

Proof of Purchase

Class Members must provide the cell phone number at which they received the automated Capital One debt collection calls.

    I have talked to one of the lawyers atoorneys involved in this case and for each individual class member involved other than the lawyers will recieve $20 in the mail. Not sure when though.

    in 2012 i received a card for a different settlement was told the same that it would be a small amount but this all depends on how many ppl reply it took awhile but i received a check for 3700.00 its all based on how many ppl then hey look at how many calls were made and thats how much you get so one person may have been called 5 times and another 15 the amount is for example 25 x 5 verses 25 x15 depending on how many ppl responded.

    I’m really confused or someone is saying to the claimants that we have a problem with adding and subtracting. The comments claim that there are 1,378,534 claimants and a total of $47,700,569.12 left after all lawyers and fees are paid from the original amount. The way I figure it is that each claimant should receive about $34,000 and not $34.00. Now, I have to ask myself, what happens to the rest of the money if in fact, claimants will receive only $34.00? Someone seriously need to check into this matter. If not, then what was the point of being involve in this class action lawsuit?

    So how did you get your calculations. Forty million dollars divided by a million something people would be around 34 thousand dollars, not 34 dollars, and also the final approval hearing wasn’t until Jan 15th so how did they come to a decision in Dec.

      I was about to ask that same question. Also sharp301’s math is correct. I don’t know how people keep getting $34,000 or $3,400 or better yet $3,460, unless they forgot there’s 2 numbers behind the decimal, which would make $3,460 look more like $34.60

    Estimated Payment to class members= Estimated fund after lawyers and expenses= 75,455,098.74 minus $27, 754, 529.62= $47.700, 569.12 then you have to divide the number of claimants as described below: Here is the calculation:

    $47,700,569.12 / 1,378,534 claimants = $34.60 pro rata payment this is in the last page of final approval order.

    All you have to do is pull it up and print it out like I did folks, not sure when payment will be sent out, but it was approved on December 22, 2014.

      How did you pull it up, like with Google search or something of that nature? Didn’t even know a decision had already been made. I’ve been wondering when they would come to a decision.

    I dont know what is taking these people so long, all I know is that my house recently caught fire and I’m needing some cash to fix the damages!
