Capital One Bank USA NA has agreed to pay $3 million to settle a class action lawsuit alleging the bank illegally recorded outbound customer service calls. If you received a telephone call from Capital One between July 13, 2006 and March 31, 2012 and you were not notified that the call may be monitored or recorded, your rights could be affected by the class action settlement.
The Capital One class action lawsuit alleges that telephone calls made by representatives of Capital One regarding credit card accounts were recorded or monitored without providing verbal notice that the calls may be recorded or monitored.
Capital One denies the allegations but has agreed to settle the call recording class action lawsuit to avoid the burden, expense and uncertainty of further litigation.
Under the terms of the call recording class action settlement, Capital One will pay a total of $3 million in the form of credits on Capital One credit card statements, forgiveness of debt owed to Capital One, and cash to create a common fund.

The appeal must be over because the website is now saying this
On November 17, 2014, the United States District Court for the Central District of California granted Final Approval of the Nader v. Capital One Bank (USA), N.A. Settlement. You may read the Court’s order here.
UPDATE: According to a post on the settlement website, the Capital One call recording settlement received final approval on Nov. 17, 2014. However, there is an appeal pending and the distribution of settlement funds cannot be made until the appeal is resolved.
Who is appealing? This was announced as a final approval of the settlement. I interpret that to mean that both sides have agreed, and the court has cleared all issues between the parties. When I contacted the administrator, I was given a cryptic answer to the effect that the defendant is the only one who would appeal. Can someone explain this?
