Capital One class action lawsuit

Capital One Bank USA NA has agreed to pay $3 million to settle a class action lawsuit alleging the bank illegally recorded outbound customer service calls. If you received a telephone call from Capital One between July 13, 2006 and March 31, 2012 and you were not notified that the call may be monitored or recorded, your rights could be affected by the class action settlement.

The Capital One class action lawsuit alleges that telephone calls made by representatives of Capital One regarding credit card accounts were recorded or monitored without providing verbal notice that the calls may be recorded or monitored.

Capital One denies the allegations but has agreed to settle the call recording class action lawsuit to avoid the burden, expense and uncertainty of further litigation.

Under the terms of the call recording class action settlement, Capital One will pay a total of $3 million in the form of credits on Capital One credit card statements, forgiveness of debt owed to Capital One, and cash to create a common fund.

Who’s Eligible

You are a Class Member of the call recording class action settlement if you received a telephone call from Capital One between July 13, 2006 and March 31, 2012 while you were in California, Florida, Maryland, Nevada or New Hampshire, and were not provided with notice that the call may be recorded.

Potential Award

The actual amount received by each Class Member will depend on the number of timely and valid claim forms submitted.

UPDATE: On Jan. 19, 2016 readers began reporting they were receiving checks in the mail from the Capital One call recording class action settlement. Congratulations to everyone who submitted a valid claim and got PAID!

Proof of Purchase

N/A. Class Members must provide the telephone numbers at which they received the telephone calls and the approximate dates the calls were received. Class Members must attest under the penalty of perjury that the information submitted in the Claim Form is true and correct.

    Really Feb. 30th? That day doesn’t exist in the calendar. Your nothing special in predicting payouts. Your basing this on???? Not facts.

    Read the details – this is not compensation for their business practices – simply compensation if you were not notified calls were being recorded, and then only if you are a resident of the stated states.

    If you were called, they have record of the phone numbers and have sent you a card with claim number about this. If you didn’t receive a card, then they have no record of you being called unless you have changed you phone number. They will check to see if you were actually called if you submit the claim form – that’s why they need you ss – to verify, and weed out fraudulant claims! So if you are simply being greedy and claiming you were called, when in fact you weren’t, then save you time – you won’t get paid anyway !!!

    PLEASE BE AWARE THAT THEY ASKING FOR SOCIAL SECURITY NUMBER ON THE CLAIM FORM ,THEY SHOULD ALREADY HAVE IT INTHEYRE RECORDS,I DONT LIKE GIVING OUT MY NUMBER ONLINE.

      for the ones saying, they shouldnt ask for your SS # ,Um their only asking for the last 4 numbers which any place does and giving the last four numbers is not giving your SS number out ! may be captial one has its reps hear scaring people off from failing a claim !

    I was a customer of Capital One and you could never pay your credit card of ,it was always a hidden charge I was charged a yearly fee and then charged twice a year then I tore up my card .

    I was contacted by Capital One about a secure credit card. After I closed the account I started to receive call after call and letter after letter. One call stated that the was writing a balance off but there was no balance. I am glad someone are finally going to hold them accountable.

    dates and years were speculation on claim. Can only recall the multiple time calls were made to me. If you have my name on this class action suit it must have happened. SS numbers is also showing privacy act violations. However it was submitted. I never gave the auhorization for such release. Look forward to this claim. I have been recently getting letter after letter from capital one after a car purchase. Interesting.Notify me when it is finalized.

    I live in Connecticut but was called multiple times on multiple occasions by capital one without anyone ever making any statements about recording the conversations. It was such an overabundant amount of phone calls that I know if I look back in my records I would find all the phone calls that were made to me. Am I able to file suit since I live in Connecticut?

    I don’t like the fact that providing my SS # is mandatory.
