If you live in California and called P.F. Chang’s and/or Pei Wei’s customer service line, you may be eligible for compensation from a $2.7 million call recording class action settlement.

The P.F. Chang’s, Pei Wei call recording class action settlement puts to rest claims that the company violated California call recording laws.

Plaintiffs alleged in a class action lawsuit that their rights as California residents were violated when they called the customer service line of the popular restaurant chain and were not informed that their call could have been recorded.

California call recording lawsrequire that all parties to a phone call consent to the recording of the call. These state laws are why consumers often hear a notification that calls will be recorded when contacting customer service phone lines.

In fact, California’s Constitution is the basis for California call recording laws. Those in California have an inalienable right to privacy — companies that fail to inform Californians that they record calls to and from customer service violate that right and can face steep fines and other consequences.

The restaurant chain admits no liability under the terms of the California P.F. Chang’s, Pei Wei call recording class action settlement.

According to the California P.F. Chang’s, Pei Wei call recording class action settlement, calls in and out of the customer service line did not notify callers that the phone call would be recorded between March 1, 2016 and Sept. 20, 2017.

Class Members include those who were in California who received or made a call to Pei Wei Asian Diner or P.F. Chang’s toll-free customer service line and talked to a representative during these dates. Class Members have until Oct. 5, 2018 to file a claim.

Those who wish to exclude themselves or object to the California P.F. Chang’s, Pei Wei call recording class action settlement have until Oct. 5, 2018 as well.

A final fairness hearing will be held Nov. 13, 2018.

Who’s Eligible

Class Members include those who made or received calls from the P.F. Chang’s or Pei Wei Asian Diner from March 1, 2016 to Sept. 20, 2017 and were not informed that their call would be recorded.

Potential Award

$150 per call (estimate)

Proof of Purchase

Claim ID number and/or the phone number(s) that was used to make or receive the call(s).

    Good question I’ve been calling the claims admin weekly and today they had a 30 minute wait before I was able to speak to a live person! I had my case escalated to a case manager? They (KCC) ended up calling me back and leading a voice mail that said my claim is valid and they’ll give me a call back as soon as the checks are issued ….. sounds like more of the waiting game

    Those receiving over 600, our checks will be mailed on the 17th according to Eric Grover there was a delay due to claimants sending in their tax info later than anticipated

    Thanks to whoever called today and confirmed that checks went out on Monday. When I called last week, I was told to check back on the 19th. If they were handed to USPS on Monday then we should start seeing them arrive tomorrow. I also think that it’s ridiculous that people who need to fill out a tax form just received them. They’ve had a while to figure out that people with 3+ calls would need to fill one out.
