Kohl's class action lawsuit

Kohl’s Corp. has reached a class action settlement over allegations that it requested and recorded customer ZIP codes during credit card transactions in violation of Massachusetts law. If you made a credit card purchase at a Kohl’s store in Massachusetts between 2009 and 2013, you may be eligible to claim a free Kohl’s gift card from the class action settlement.

Who’s Eligible

Class Members of the Kohl’s ZIP code class action settlement include all persons who from April 16, 2009 through Nov. 26, 2013:

  1. purchased merchandise from a Kohl’s store in the State of Massachusetts,
  2. used a credit card to make the purchase(s), and
  3. whose personal identification information was requested and recorded by Kohl’s at the point of sale.
Potential Award

Kohl’s gift card. The amount of this gift card will depend on how many eligible claims are filed and approved.

Proof of Purchase

Proof of purchase does not appear to be required to submit a Claim Form, but Kohl’s has the right to dispute claims and may request that you provide credit card statements or store receipts to back up your claim.

Case Name

Jacqueline Brenner v. Kohl’s Corp., Case No. 13-cv-10935 RGS, U.S. District Court, District of Massachusetts.

Case Summary

The Kohl’s ZIP code settlement resolves a class action lawsuit (Brenner v. Kohl’s Corp.) that accuses Kohl’s of violating a Massachusetts state law that prohibits companies from requesting and recording personal identification information in connection with credit or debit card purchases.

Kohl’s denies any wrongdoing but has agreed to establish a $425,000 class action settlement fund to pay out Class Members and resolve the litigation. If the class action settlement is approved, Gift Cards of the “appropriate amount” will be sent to Class Members who submit valid and timely Claim Forms to the Settlement Administrator.

Yes they have done this in NC. also! I have chose to cancel my Kohl’s shopping credit card for I do not like their return policy and announced this verbally on phone with customer service when they asked “Why”.
I have experienced this with Kohl’s and do not longer wish to patronize this company because of what I experienced. Two things… pettiness and absurdness. (period)
