Brazilian Blowout settlementDetails on how to file a claim for the Brazilian Blowout class action settlement have arrived. If you purchased a Brazilian Blowout solution or received treatment using these products, you may be entitled to a cash payment under the class action settlement.

A federal judge preliminarily approved the $4 million Brazilian Blowout class action settlement on June 5, which will resolve claims that the manufacturer of the products, GIB LLC, failed to warn consumers and salon workers that the popular hair-straightening product emits toxic formaldehyde gas – a known carcinogen. Labels for the product deceptively said that it was “formaldehyde-free,” “salon safe” and contained “no harsh chemicals,” according to the class action lawsuit (In re: GIB LLC Cases).

Class Members of the Brazilian Blowout settlement include all persons or entities in the U.S. who purchased Brazilian Blowout Products from GIB or one of its authorized distributors on or before June 6, 2012 (“Stylist” Class Members) or who underwent a treatment using Brazilian Blowout products on or before June 6, 2012 (“Consumer” Class Members).

The Brazilian Blowout class action settlement will provide cash payments to stylists and consumers out of a $4,225,000 settlement fund.

Stylists who submit a valid Claim Form will receive $75 for each purchase of a Brazilian Blowout product. Stylists may also choose to forfeit their cash refund and choose to return, at no expense, unopened bottles for an exchange with a bottle of new Brazilian Blowout Zero.

Consumers who submit a valid Claim Form will receive $35 for each Brazilian Blowout treatment they received, up to a maximum of three treatments ($105).

Any Class Member in either category (Stylist or Consumer) can also claim up to $2,000 in medical reimbursement if they include records that reasonably demonstrate medical expenses incurred as a result of experiencing any short-term symptom or condition caused by exposure to the formaldehyde in the Brazilian Blowout products. The qualifying transitory symptoms/conditions for medical reimbursement include:

  • Eye disorders (irritation, increased tearing, blurred vision, hyperemia),
  • Nervous system disorders (headache, burning sensation, dizziness, syncope)
  • Respiratory tract disorders (cough, nasal discomfort, wheezing, throat irritation, etc.)
  • Nausea hypotrichosis, chest pain, chest discomfort, vomiting, rash

The only way to receive a cash award from the Brazilian Blowout settlement is to submit a valid Claim Form and supporting documents no later than September 23, 2013.

    I received a letter last month stateing that i filed twice but would only be paid for one and the amount was 400.00. But I have not received a check, I have sent them three emails, called twice but only get answering machine-no person, and today sent them a message on their facebook page. Does anyone know how to contact a real live person?

      Sweet, When they first came out with the claims I believe you could get paid 3 x $35 with no proof. Later the claims changed and if you claimed more then one you needed proof of claim 2 and 3 from the salon. This has happened in a few claims, they change and if you send a second claim correcting their changes you get rejected. It turns out the 70.59 was for one treatment.

      Quick question. Some of us received settlements of $1500 or more. Are we going to get 1099 misc forms and have a tax liability. I don’t remember giving my social security number or business number so how can the send a form? Thanks

    the word with ANTHONY now,if you didn’t receive your check when they mailed them out (03/21/2014)you wont receive one. oh, and now he says you didn’t have a claim in.I know there has to be someone you can report this administrators to.this will continue to go on, until the light has been shown on them.they are not abiding by the court rules.
