A settlement has been reached between BMW of North America and the Class of consumers who allege that the water pump in their MINI Cooper suffered from defects concealed by the manufacturer.
Plaintiff Trish Herremans originally filed the class action lawsuit in March 2014 alleging that a design defect present in the water pumps of 2007 to 2013 MINI Coopers caused the part to fail.
As a result of the water pump failure, the engines overheated and stalled in response, according to the claim.
Herremans alleged that her water pump failed twice and said she had to pay $1,700 for the repairs since the warranty on her car had expired.
Initially, the class action lawsuit was successfully dismissed by BMW. However, following Herremans’ amended complaint filed in March 2015, BMW responded by agreeing to participate in mediation to resolve the claims.
Both parties agreed to the terms of the settlement following a successful mediation.
BMW continues to deny any wrongdoing, and entered into a settlement to avoid further cost, time and uncertainty associated with future litigation of the case.
Under the terms of the settlement, BMW agreed to compensate consumers for any repairs made to replace the water pump in 2007 to 2013 MINIÂ Coopers. Eligible Class Members will receive up to $500 for any repairs already completed.
Should any other individuals experience water pump failure in their MINIÂ Cooper vehicles during the Settlement Warranty Period, the part will be replaced at no charge to the owner or lessee and can be taken directly to a dealership for repair.
BMW has also agreed to pay an additional $692,500 in attorneys fees and costs and a service award in the amount of $2,500 to Herremans for her service as Class Representative in the MINI Cooper class action lawsuit.
Individuals who choose to exclude themselves from the settlement or object to the settlement must do so no later than Aug. 26, 2016.
Who’s Eligible

30 thoughts onBMW MINI Cooper Water Pump Class Action Settlement
Can we start a new class action or have this one reopened? I have owned 4 cooper and I’m about to replace the 4 water pump! Totally should have been a recall or at least a bulletin!
Mine just went, 2012 Mini Cooper base with 54,000 miles. I’m not sure if this will be covered, I still have to take it to be looked at by mini
I am currently in our Auto Repair shop waiting while my water pump gets replaced in 2011 Mini Cooper. This should be covered! Disgrace
I’m over miles now and Mini says sorry. This needs to be reopened.
Another waterpump failure with only 55,000 miles on 2010 mini. Like the others these class actions should turn into recalls and never expire. Plastic impellers are poor design.
I agree, my 2010 had one replaced and now needing it again..not sure why this was never a recall.
Just had my 2010 Mini S Clubman’s water pump replaced. 92,000 miles. 31 August 2018. Paid $800.00. Class actions shouldn’t be allowed an expiration date. Rich lawyers win again. Consumers lose.
My wife is having her water pump for her 2009 Mini replaced tomorrow. I guess she gets nothing. So typical. The attorneys make a ton of money but the compensation is strictly limited.
Who do we contact to check status on the check and claim?
Just had my water pump fail and has caused the engine to fail, stall and even caused considerable damage to the head gasket. $2400 in damages. Really wish I had received notice of this issue from my dealership!
Mine also has just failed. 2013 Mini Cooper S, very low mileage.
I guess I’m a day late and a dollar short; Dealer just told me that my 2009 Mini Cooper water pump needs replacing ($580)… Would have liked to have Mini pickup $500 of the cost!!!
My 2011 waterpump had to be replaced today, and I found this information! Should I call Mini?
