Mini Cooper Water Pump Defect Class Action Reaches Settlement

Last week, a California federal judge preliminarily approved a class action settlement over allegations certain Mini Cooper vehicles had defective water pumps, finding the proposed terms were “fair, reasonable and adequate.”

Under the terms of the water pump defect class action settlement, BMW of North America LLC will pay up to $500 to owners or lessees of Mini Coopers who paid to have an allegedly defective water pump repaired or replaced.

The proposed Mini Cooper class action settlement will resolve a class action lawsuit, filed in March 2014, that alleges BMW failed to notify consumers about a design defect in tens of thousands of 2007-2013 Mini Coopers that makes the vehicles’ water pumps likely to fail. Plaintiff Trish Herremans alleged that BMW actively concealed the design defect from consumers, which she alleges causes the engines of affected vehicles to overheat and stall.

Herremans alleged in her BMW class action lawsuit that the water pump in her Mini Cooper failed twice. She claims that she paid $1,700 to have the water pump repaired because the failure occurred after her warranty had expired.

BMW’s attempts to have the Mini Cooper water pump defect class action lawsuit dismissed were successful on two occasions. Herremans filed an amended complaint in March 2015 that includes claims under California’s Consumer Legal Remedies Act and Unfair Business Practices Act. BMW agreed to participate in mediation to resolve the litigation. The parties reached a settlement in November 2015.

On Friday, U.S. District Judge George H. Wu found that the settlement didn’t contain any obvious deficiencies, and that notice of the deal should be sent to Class Members so they can evaluate the terms themselves. Notice will be mailed to all identified Class Members. In addition, the Settlement Administrator will establish a website that contains information about the Mini Cooper class action settlement.

Class Members of the BMW water pump defect settlement include anyone in the United States who has owned or leased a MINI R55, R56, R57, R58, R59 or R60 vehicles made for sale and/or lease in the U.S. market with a production date between October 2006 and November 2012.

The final fairness hearing for the Mini Cooper class action settlement has been set for Nov. 28, 2016.
