Big Fish Casino has agreed to resolve two class action lawsuits against it with a $155 million settlement deal. The settlement will provide cash payments of varying sizes depending on the amount spent on in-app purchases.

The settlement benefits individuals who played Big Fish Casino, Jackpot Magic Slots or Epic Diamond Slots on or before Aug. 31, 2020.

Plaintiffs in the Big Fish Casino class action lawsuits claimed the online game platform counts as illegal gambling due to the nature of the games. Through in-app purchases, users allegedly wager real money on these games.

According to the plaintiffs, these games therefore violate Washington gambling laws.

“Defendants’ online gambling games are illegal gambling games because they are online games at which players wager things of value (the chips) and by an element of chance (e.g., by spinning an online slot machine) are able to obtain additional entertainment and extend gameplay (by winning additional chips),” the Big Fish Casino class action lawsuit argued.

One plaintiff, Manasa Thimmegowda, said she started playing Big Fish Casino games in November 2017. Since then, she allegedly has lost more than $3,000 through in-app purchases.

Thimmegowda’s experience is allegedly not unique.

She argued that Big Fish Casino has taken advantage of thousands of consumers through the same illegal gambling scheme. In fact, in 2017, free-to-play “gambling” games allegedly generated more than $3.8 billion in profits for the operator.

The plaintiff said these profits are mostly gained through in-app purchases.

“By operating Big Fish Casino and other similar online gambling games, Defendants have violated Washington law and illegally profited from tens of thousands of consumers,” Thimmegowda argued in her Big Fish Casino class action lawsuit.

Big Fish Casino has not admitted any wrongdoing but has agreed to resolve the claims against them in a $155 million settlement. The deal ensures plaintiffs and Class Members can recover compensation while also avoiding the costs and risks of a trial for all involved parties.

The settlement deal provides cash payments depending on the amount spent on Big Fish Casino games. Settlements may vary from $7.50 to $100,000, depending on how much each Class Member spent and the number of claims filed with the settlement administrator.

The settlement website features an estimated recovery tool to give Class Members an idea of how much they may receive.

In order to benefit from the Big Fish Casino class action settlement, Class Members must file a valid claim from by Jan. 4, 2021. No proof of purchase is required to benefit from the settlement, but Class Members may be asked to provide information about their Big Fish Casino account (friend codes, email addresses, etc.).

The deadline for exclusion and objection is Jan. 4, 2021. The final approval hearing for the Big Fish Casino settlement is scheduled for Feb. 11, 2021.

Who’s Eligible

Individuals who played Big Fish Casino, Jackpot Magic Slots or Epic Diamond Slots on or before Aug. 31, 2020.

Potential Award

Cash payments depending on the amount spent on Big Fish Casino games.

      so i wonder if we will get a very small third check from the interest that was accumulated from this money that was sitting in the bank for additional days? payout date should have been 11/05 but wasn’t sent out until this morning 11/12 and i say this morning since the money was out of their bank and in our banks, just a thought.

        I had $5k in my Wells Fargo account. The monthly interest was 9 cents! So I doubt whatever delay of a week occurred would result in much of anything for each of us.

    Good morning. I received my second payment this morning (Woodforest bank). I didn’t get the last email they sent with the amount and I didn’t challenge the first payment.. It is about 27 percent of first payment.

    My CU posted transactions after midnight and no ACH was made. So makes no sense. Why say before the 11th when it doesn’t happen?

      It is a federal holiday so it will not pots today. As per the generic email sent it stated that on or before the 11th it would be sent. So if not received tomorrow it would be Monday. I know we are all frustrated, the handling of not advising is what was going on until the complaints piled up in wrong. However, don’t stress yourself out. We have no control.

      So today keep your mind busy and think about the scrumptious holiday treats you will either bake or indulge in and smile.

        Yes. I challenged and got the same 27% that everyone else is getting. I sent an email to the administrator about it. If my status changed from DRP to Non-DRP, I should have gotten a bit more than the 27%. In fact, doing the math, I think I should have gotten about 75% of the first amount. Not sure what my recourse is but I did ask them.

    I’m in SWFL and just got email that it was sent yesterday, with the amount. It’s 27.2% of my 1st payment. Of course I bank with a Credit Union and it’s not there. So I expect tomorrow, could “possibly” be later today but I doubt it. So it’s coming ya’ll, we just gotta wait a little longer if we didn’t have it released today.

I am not sure how they are getting away with this. Very unprofessional , it is pretty disgusting. I am not in a hurry for any money but wtf. We should have all been updated .

Just curious what last initials are for folks that did get the email?     Yay! 7:09pm Central Time and just got my ACH conf email with my amount. My bank makes funds available to me as soon as the ACH is initiated so they didn’t submit it today like the email says. Regardless, I’m happy it’s OTW.

I didnt send any emails to them so assuming everyone waiting for bank/cu deposits will recieve a email w/ personal info about amount and transaction info. I am receiving 27.1 % of 1st payment.       Received my notice of distribution email at 9:05pm yesterday (Wednesday). The amount is 27.08% of my 1st payment. I bank with a CU in Florida and nothing in my account this morning. Hopefully will be there on Friday. Thankful for the communication. Good luck all, the end is near! Yay!

    I’m so sick of the lies, they have told us, computer issues, death in the department, no back up files. I think it’s time to reach out to counsel again, I don’t have the information. I sent another email to them today, but of course, no response. This has become very annoying, the last ACH cutoff for today was 4:45pm EST. for same day processing, of course it could be on the 8pm file because they have been so slow but that puts us at Friday automatically unless you used a prepaid service.
