Big Fish Casino has agreed to resolve two class action lawsuits against it with a $155 million settlement deal. The settlement will provide cash payments of varying sizes depending on the amount spent on in-app purchases.

The settlement benefits individuals who played Big Fish Casino, Jackpot Magic Slots or Epic Diamond Slots on or before Aug. 31, 2020.

Plaintiffs in the Big Fish Casino class action lawsuits claimed the online game platform counts as illegal gambling due to the nature of the games. Through in-app purchases, users allegedly wager real money on these games.

According to the plaintiffs, these games therefore violate Washington gambling laws.

“Defendants’ online gambling games are illegal gambling games because they are online games at which players wager things of value (the chips) and by an element of chance (e.g., by spinning an online slot machine) are able to obtain additional entertainment and extend gameplay (by winning additional chips),” the Big Fish Casino class action lawsuit argued.

One plaintiff, Manasa Thimmegowda, said she started playing Big Fish Casino games in November 2017. Since then, she allegedly has lost more than $3,000 through in-app purchases.

Thimmegowda’s experience is allegedly not unique.

She argued that Big Fish Casino has taken advantage of thousands of consumers through the same illegal gambling scheme. In fact, in 2017, free-to-play “gambling” games allegedly generated more than $3.8 billion in profits for the operator.

The plaintiff said these profits are mostly gained through in-app purchases.

“By operating Big Fish Casino and other similar online gambling games, Defendants have violated Washington law and illegally profited from tens of thousands of consumers,” Thimmegowda argued in her Big Fish Casino class action lawsuit.

Big Fish Casino has not admitted any wrongdoing but has agreed to resolve the claims against them in a $155 million settlement. The deal ensures plaintiffs and Class Members can recover compensation while also avoiding the costs and risks of a trial for all involved parties.

The settlement deal provides cash payments depending on the amount spent on Big Fish Casino games. Settlements may vary from $7.50 to $100,000, depending on how much each Class Member spent and the number of claims filed with the settlement administrator.

The settlement website features an estimated recovery tool to give Class Members an idea of how much they may receive.

In order to benefit from the Big Fish Casino class action settlement, Class Members must file a valid claim from by Jan. 4, 2021. No proof of purchase is required to benefit from the settlement, but Class Members may be asked to provide information about their Big Fish Casino account (friend codes, email addresses, etc.).

The deadline for exclusion and objection is Jan. 4, 2021. The final approval hearing for the Big Fish Casino settlement is scheduled for Feb. 11, 2021.

Individuals who played Big Fish Casino, Jackpot Magic Slots or Epic Diamond Slots on or before Aug. 31, 2020.

Potential Award

Cash payments depending on the amount spent on Big Fish Casino games.

          Well we did get more than what they had stated in the 1st round. So I expect this one to be less. I got like 3k more in 1st payment then what I should have gotten and I know alot that got more than they should have. So you can’t expect them to give the same for the 2nd payment if the 1st was more than they had planned. I’m just happy to get any back, but they need to hurry and get ours, those that’s using banks/CU, ours already. No update or anything is some bullshit. No way EVERY bank/CU is rejecting or denying these deposits.

            Trust me nothing was rejected or failed I called my bank and the girl said nothing came through yesterday nothing was coming through today and she said she can even see possibly some stuff for tomorrow and still didn’t see anything but what I don’t understand if they know that nobody was getting their deposits already yesterday why didn’t they go in and fix it yesterday??

      Well I just got off the phone with my bank and she said to me that nothing was rejected or failed as far as a deposit yesterday she doesn’t see anything in my account for today and she said sometimes they can even see deposits coming in for tomorrow but she doesn’t see anything for that either so I’m sorry I think we’re getting the God damn run around ugghhh

        I agree, I believe they doing some shady crap. There’s no way it was all sent out Friday like they claim. Everyone is getting theirs besides those that used a bank or CU, they screwed something up or they’re just flat out lying. My deposit came in with zero issues in July so should be the same this time.

        Yes, there is an issue with the ACH transmissions. We are working on it. Initially, I was told it would be resolved today but now it looks like
        tomorrow. I’m trying to get more information.

      And we’re obviously not all getting checks because my mail came yesterday and I already came today and I got nothing and I think it’s pretty shady that everyone seems to be getting 27% of their first payment I don’t know I just don’t like the fact that they didn’t send out emails telling us what we were getting and now no one’s getting their money in their bank accounts this is just ridiculous and like I said if they knew that everyone was having problems with deposits yesterday why didn’t they go in and fix it yesterday cuz nothing came through my bank as rejected or failed they’re just lying

        Yeah does seem shady. Because what I read is it was prorated based on when each one filed. Yet EVERYONE so far is getting 27% of first payment, guess everyone filed at the same exact time. Regardless of percentage, they need to get the issue with the banks fixed, this is bullshit and they know it. PayPal and zelle is ACH as well, yet people got them that way Friday, so why the hell aren’t banks. They’re full of it.

    I understand problems occur and that there is possibly an error with the ACH. What I don’t understand is why we’ve had to reach out to Attorneys to try to determine what’s going on. A simple update to the settlement website would give us some answers but they haven’t bothered posting anything since July. Just really disappointed and think this could have been handled better.

I mean u have all the info from last time and seriously u can’t hit a button correctly lol but if an ACH was rejected or failed wouldn’t our banks see that? Cuz I called my bank yesterday and they didn’t see anything…. rejected failed etc so that tells me that they didn’t send it on the 5th like they said but yes some damn info would be nice cuz all this conflicting info is getting crazy…I seen that we would have them Wednesday or Thursday but that can’t happen cuz thur is a bank holiday and then I seen something about next week which if true is total BS…uggghh it’s just because I really need the money right now that this is happening never fails

    Looks like mine is arriving today just got notified through my app of what’s in the mail….and it’s there…..So it looks like they are mailing checks….so it might be true about ACH Deposits not being able to get done….I was also ACH Deposit with BOA & I’m in Florida…..looking forward to see how much it is….and glad this wait is over….and so grateful to have some of it returned and for all of you for the information provided here on this site… A big thank you to you all….

        No I didn’t…. although that is what I requested…..It was extremely delayed and had to do all the paperwork to receive a reissue of the money…..I guess they had issues with making deposits at that time with a few banks….so some of us received checks…

    Still nothing in my CU this morning. So that means they didn’t send everyone out at the same time. Nor sure how they are deciding on who gets theirs first, but it’s a shame people are getting checks before people are getting deposits.       The ACH payments are delayed the hope to have them going tomorrow or the next day. Relax, it is coming. Continue to feel blessed you get anything back, when you made the purchase there was no promise to a refund…. breath, take a chill pill or whatever it is you need to do, you will get your deposit in a day or two.

I think it’s unfair for you to tell people to chill when people are excited and sometimes in need of this additional money. While it’s a gift for sure, it became something promised to us by being part of the settlement group – so when you are expecting something and maybe actually need it, the details matter.

    Honestly I think we are possibly getting checks because the last time was such a hassle. If we were getting direct deposit’s it would have been today. Far as I know the only people to get their money was from PayPal? I hope it’s not true because I don’t even see where they are responding now but they are active on twitter Angeion Group and I’ve been sending tweets to try to get their attention but I don’t think they care anymore because they’ve made their money.

      I finally got a response from the administrator (after lead counsel called them) and they said some deposits could be Wednesday or Thursday and he said the payments did not have to be made by nov 4th just the settlement amounts determined. I sent him a screenshot of the court document that clearly says all disbursements must be paid within 30 days which was Nov 4th (5th if you do close of business day). Regardless, many of us won’t receive a deposit until tomorrow or Thursday! I’m just happy to know the deposit did not fail and he did verify that.

        I was told that they will know by Wednesday or Thursday if the direct deposits were rejected. They said the file was sent on Friday. If the file was correct we should have it no later then Monday just saying. Also Thursday is a federal holiday so banks won’t be processing anything. This is the worst company ever. If no has a pending transaction I believe the ACH file is wrong or misdated.

            I spoke to settlement administrator told him according to this and another website it seem nobody got their direct deposit they said they won’t know anything til Thursday which I find funny cause Thursday is a bank holiday. So I doubt they will be getting a report from their bank on Thursday about rejects. Highly unlikely that every direct deposit rejected. Their file probably misdated or incorrect.
