MONROVIA, CA/USA - NOVEMBER 22, 2015: Bank of America sign and logo. Bank of America is an American multinational banking and financial services corporation.

Those who had a personal bank account with Bank of America and paid overdraft fees on debit card transactions made with Uber between Jan. 1, 2012 and Dec. 31, 2016 that were not classified as one-time (non-recurring) charge may be entitled to benefit under a proposed settlement agreement.

Bank of America has agreed to pay $22 million to end a class action lawsuit that alleged the bank wrongfully charged overdraft fees on debit card transactions made with Uber. The Bank of America class action lawsuit claimed that this conduct breached Bank of America’s account agreement with its customers.

Many consumers are reporting increased and allegedly unfair overdraft charges from banks, including Bank of America. Further, banks have been accused of processing transactions out of order to maximize fees at the expense of the consumer.

Bank of America denies any liability under the terms of the settlement agreement, but will pay approximately $20 for each overdraft fee it charged to Class Members. The bank will also pay $5.6 million in attorney’s fees and a settlement award of $7,500 to each plaintiff.

Class Members who want to object or ask to be excluded from the terms of the Bank of America, Uber overdraft fees class action settlement must do so by June 22, 2018.

UPDATE: On July 24, 2018, a group of state attorney general offices sent a letter asking a New York federal judge to deny a proposed $22 million class action settlement with Bank of America over claims it improperly charged overdraft fees on debit card transactions with Uber Technologies Inc. The AG offices expressed “significant concern” over the fact the proposed BofA class action settlement releases Uber from liability because Uber was not a defendant or a party to the litigation, nor is it an agent of Bank of America.

Who’s Eligible

Class Members include those who held a consumer bank account with Bank of America, and were charged (and not refunded) overdraft fees on debit card transactions made with Uber between Jan. 1, 2012 and Dec. 31, 2016 that were classified by Uber and/or Uber’s agents as recurring transactions.

Potential Award

$20 per overdraft fee.

Claim Form Deadline

There isn’t a Claim Form deadline, Class Members will automatically receive payment from this settlement unless they opt out or exclude themselves by June 22, 2018. Class Members are expected to receive payment automatically within 60 days of the final hearing which will take place on Aug. 8, 2018.

    BOA has been charging me fees for everything I do.I live 100 miles away from the nearest bank and BOA moved from my town now everytime I use a ATM it cost me $5.00.
